The Nepal Bar Association has said that it will not welcome any appointment from the Judicial Council until the revised rules are repealed.

In a statement issued by Bar General Secretary Kedar Prasad Koirala on Friday, drawing attention to the recommendation made by the Judicial Council on Thursday for the appointment of 27 judges for the High Court, it said that the appointment will not be welcomed.

'It is our unwavering demand that the amended and discriminatory regulations of the Judicial Council should be immediately repealed, transparent, objective and predictable criteria should be determined for the appointment of judges and the principle of proportional inclusion should be fully implemented in accordance with the spirit of the Constitution', the statement said, 'Until this demand is met and the revised regulations are repealed, the Nepal Bar Association will not welcome any appointment from the Judicial Council.'

The statement said, 'The council has completely ignored the concerns of the bar while making such a significant and far-reaching decision, it is against the principles of cooperation and transparency, such practices promote arbitrariness.'

Since the post of judge is a legacy of public trust, it should be given on the basis of merit and ability, according to the bar. It is said in the statement, 'The judicial reform reports, which have expressed the promise of many reforms, have only become symbolic documents, and the responsible party seems to be indifferent to its implementation.' The

bar has claimed that this appointment completely ignores the meaning and spirit of the proportional inclusive state envisioned by the Constitution of Nepal. "This appointment has rejected the fact that meaningful representation of women, different geographical areas, classes and communities should be ensured in an important body like the judiciary", the statement said, "Such an unbalanced appointment has seriously hurt everyone's sense of equal access and belonging to the judiciary." It has weakened the faith in the justice system.'
