Spokesman Shivkumar Sapkota said that the Ministry of Education, Science and Technology is going to make policy arrangements for the establishment and operation of the fund. The Ministry's program implementation procedure for the current financial year mentions making legal arrangements to establish a fund. For the implementation of compulsory and free education up to the secondary level (class 12), a fund is going to be established and operated in partnership with the union, state and local levels.

Even though the Compulsory and Free Education Act 2075 has been issued as stipulated in the constitution, it has not been implemented. Last year, the then Education Minister Vidya Bhattarai started the implementation process by publishing the draft of the action plan regarding the implementation of free and compulsory education. The Ministry estimates that an additional 2 trillion 30 billion is required for the implementation of the Act. This budget is almost twice the budget allocated for the education sector. In the current year, 2 trillion 11 billion 17 crores have been allocated to the education sector. The budget is for the entire education sector, including higher and technical, except for schools. The

Act has made provision for compulsory education up to the basic level (class 8) and free up to the secondary level. The spokesperson of the Ministry of Education, Sapkota, said that the details of the students who are out of school are being collected across the country. A survey is being conducted on the availability of education up to class 8. "Not only the statistics of children who are out of school, but also the names have been collected," he said. Scholarships and hostel facilities are also available to children. According to the educational data of 2081, the enrollment rate of classes 1-8 has reached 94 percent and the enrollment rate of classes 9-10 has reached 56 percent.

The Center for Education and Human Resource Development has also said that a special program will be conducted to ensure compulsory and free education in the municipality/province with the participation of all three levels . It is mentioned in the budget implementation procedure that the program will be conducted all over the country. Spokesman Sapkota says that the implementation of compulsory and free education has started from the first week of July. The Ministry has prepared an action plan by estimating the cost of having enough teachers in schools, from examinations to first aid services for free.

Community schools have been collecting fees from parents due to lack of necessary teacher posts. If the government does not provide the necessary budget, the students are forced to charge fees for examinations, admissions, monthly etc. . The fee raised in that way is being spent on teacher's salary and other expenses. In the school education bill pending in the Education, Health and Information Technology Committee of the House of Representatives, it is proposed to automatically maintain the posts of 44 thousand relief/temporary teachers . The Ministry of Education has been predicting that there will be a shortage of teachers. In the

action plan, it is mentioned that schools can be established based on geography and population, school mapping, school adjustments and needs. There are 27 thousand 298 public schools in the country, including 15 thousand schools with less than 100 students. The government has initiated the policy of merging schools with low number of students through the budget program. 7 million 10 thousand students are studying in class 1-12.

The Ministry of Education had asked the policy research institute for an opinion and suggestion on the implementation plan of the Compulsory and Free Education Act. The foundation has suggested that the Act can be implemented in two models. According to the report, it is recommended to implement it in a step-by-step model based on the municipality and based on needs/priorities.

It has been suggested to practice different implementations at four types of local levels (village, municipality, sub-metropolitan and metropolitan) across the country. Similarly, in another model, it is recommended to implement the marginalized, rural, disadvantaged and areas without access to education with high priority.

To raise financial resources, the Foundation has suggested to increase the participation of the local level and community, to improve the resources through the local tax system and to ensure the necessary resources with the help of the federal and provincial governments. As another measure, it has been suggested that the funds for corporate social responsibility of private and public sector commercial companies, a certain percentage of income tax should be deposited in the free and compulsory education fund. Article 19 of the

Act states that since 2085, citizens who have not completed the basic level (Class 8) cannot be elected, appointed and nominated in any government service, private sector organization. Similarly, getting employment, becoming a shareholder, director or member of a company, firm, cooperative or non-governmental organization is prohibited. After the release of the

act, regulations were made in 2077, but they have not been implemented. In the regulations, it is stipulated that the public school cannot collect fees from students or parents under any title including student admission, monthly, reading, examination, textbooks.
