Most of the educational consultancy organizations (consultancy) are found to be running without registration. When the Department of Commerce, Supply and Consumer Protection monitored 100 consultancies, it was found that 70 percent were operating without registration. Only half of those registered with the Ministry of Education have renewed.

According to the director general of the department, Kumar Prasad Dahal, most of the consultancies operating without registration and renewal are sending students abroad. Their financial transactions have not been seen. They have been taking money from personal bank accounts without giving bill vouchers to the students," he said. "We have collected fines from such consultancies. We have given time to submit the documents to those who have not renewed. The spokesperson of the department, Bharat Prasad Acharya informed that fines ranging from 50,000 to 1 lakh have been paid to unregistered consultancies. 

Department, Ministry of Education and Nepal Educational Consultancy Association (ICAN) have claimed that more than 4000 consultancies are operating across the country. But 1,456 have been registered in the Ministry of Education. 720 of them have been renewed. Last financial year, 926 applied, but only 720 were renewed after completing the process, according to the higher education branch of the ministry. Most consultancies are operating in Kathmandu Valley.  According to Acharya, the spokesperson of the

department, a team has been deployed in the consultancy operating in Kathmandu, Lalitpur and Bhaktapur for two weeks. There have been complaints that more than 50 percent of the consultancies in operation are operating illegally. Even when monitoring as a model, many unregistered organizations were found, said Acharya. 

By 2072, the consultancy was established and operating after being registered with the Ministry of Education. Since 2074, it has also started to be registered in the Provincial Education Development Directorate. But no government agency has its exact details. The ministry did not renew it since 2075, showing legal complications, when it started to be registered at the state level as well. Last year, the Ministry of Education, Science and Technology issued a circular to renew educational consultancy services, preparatory classes and language teaching-related institutions (consultancy). Institutions registered according to the Educational Consultancy Services and Language Teaching Guidelines 2073 were operating without renewal since July 2075.

According to the Ministry, the approval of organizations that did not come to renew within the deadline or could not be renewed was automatically revoked. For renewal, they were asked to submit documents including company registration certificate, memorandum and articles of association, copies of educational qualifications of at least two consultants, at least two agreements with universities or colleges where the organization is providing consulting services, details of students who have provided consulting services for studies in foreign educational institutions in the last three years.

The spokesperson of the Ministry of Education, Shivkumar Sapkota, said that there has been confusion on the issue of consultancies since last year. "The ministry has given high priority to organize consultancy operation guidelines as soon as possible," he said. "We will go to an option between giving a last chance to those operating illegally and renewing them or closing those operating illegally by publishing a list of those that have been renewed," he said.

Sapkota said that since more than 100,000 students-parents take educational counseling services every year, all aspects including establishment, operation, and finances will be managed. The commerce department can also monitor and regulate within the legal framework. "Although there is no coordination, the Ministry of Education is also trying to make monitoring and regulation effective," he said. ICAN, the umbrella organization of

consultancies, is also in favor of shutting down the organizations operating without permission. ICAN President Shesharaj Bhattarai submitted a memorandum to the department and informed that it has been requested to coordinate with the Ministry of Education to make monitoring and regulation effective.
