There has been a "deception" in the Parliamentary Special Committee which was formed to investigate the "trick" of breaking the provision of "cooling off period" unanimously placed in the Federal Civil Service Bill. According to Rule 180 of the Rules of the House of Representatives, the leadership of the committee should be called "Chairman" instead of being called "Coordinator" in the formation of the Inquiry Committee.
The parliamentarians in the committee have objected that there will be a situation where instructions with suggestions must be followed when the chairperson is appointed, but when the committee is made a coordinator, the suggestions given by the committee are not binding for implementation. All the members of the committee met with Speaker Devraj Ghimire on Thursday and demanded not to weaken the parliamentary special investigation committee and to keep the leadership as 'Chairman'.
The special committee, which has been given a deadline to submit a report within 21 days, has Congress joint general minister Jeevan Pariyar coordinator and Congress whip Sushila Thing, UML MPs Narayan Prasad Acharya and Ishwari Gharti, Maoist MP Madhav Sapkota, RSVP MP Ganesh Parajuli and RPP MP Roshan Karki as members.
In the report submitted by the State Law Committee to the House of Representatives, there is a clause that violates the provisions of the 'cooling off period', which has a different meaning than the discussion, theoretical consensus, minutes and electronic records (including audio, video, etc.) of the committee.
involvement will be confirmed and suggestions will be submitted regarding whether or not any action should be taken against such official or person according to the prevailing law. There is also a mandate to find out the shortcomings observed in the discussion, decision-making process, report writing etc. during the law making process and submit suggestions on what kind of precautions or measures should be taken to avoid such shortcomings in the future.
The State Law Committee unanimously passed a report on 2nd of May in Section 82 (4) of the Civil Service Bill with the provision that "Civil servants or other government employees who have resigned or retired from the service shall not be appointed to any constitutional or government position before the completion of two years from the date of retirement". The report was submitted by Chairman Ramhari Khatiwada in the House of Representatives on June 1. However, the provision of 'cooling off period' was broken in section 82 (5A) and a provision was made that 'no appointment can be taken to a position other than a constitutional or diplomatic appointment and any other appointment made by the Government of Nepal'.
Chairman Khatiwada submitted the bill report with his signature to the House of Representatives. Chairman Khatiwada, who submitted the report with his signature to the House of Representatives with his signature for the passage of the 'Chilling Period' provision which was unanimously placed in the bill, was submitted with his signature to the House of Representatives and the special committee formed to investigate this 'cheat' was also led by Congress Joint Minister Pariyar. On the other hand, since Pariyar's wife is also a deputy secretary in the civil service, it has been commented that family relations are also linked to 'conflict of interest'.
On Thursday, during the meeting of the parliamentary special committee, the parliamentarians found out that another 'deception' had taken place by making the leadership 'coordinator' instead of 'chairman'. After that, Pariyar, Thing, Acharya, Gharti, Sapkota, Parajuli and Karki met Speaker Ghimire and complained that they were trying to form a committee to remove weeds. He also objected that the recommendations given by the committee were being manipulated so that they would not be binding. They demanded that the leadership should be the chairman.
We spoke to the speaker. "We made it clear that the Standing Committee of the Parliament forms a sub-committee and its leader is called the coordinator, but the leadership of the parliamentary special committee will be the chairman and not the coordinator," said a member of Parliament. According to a member of Parliament, General Secretary of the Parliament Padma Prasad Pandey said, "It is correct to say coordinator". As the chairman of the state administration committee, Ramhari Khatiwada, should also be called for a statement, it is easier for the head of the inquiry committee than the coordinator.''
After the discussion, the MPs suspected that the Secretary General wanted to weaken the investigation committee. Recalling the incident where Chief Secretary Ek Narayan Aryal, Federal Parliament Secretary General Pandey and a team of secretaries met the Speaker and National Assembly Speaker after the passage of the Civil Bill by the State Order Committee, a member of the inquiry committee complained that Pandey did not act according to his official responsibilities while in Parliament. The chief secretary and secretaries also met Prime Minister KP Sharma Oli and Congress President Sher Bahadur Deuba and threatened to resign en masse if the 'cooling off period' was kept. During the
discussion, Speaker Ghimire, after listening to the General Secretary and Head of Work Arrangements, asked them to focus on their work rather than being a coordinator or a chairman. After the members of the committee showed the rules collectively and made it clear that they should be the chairman and not the coordinator, Speaker Ghimire had a discussion with Congress chief whip Ghimire and UML chief whip Bertaula. After that, the proposal that the Chairman of the Special Committee should be the leader of the House of Representatives is proposed to be held in the next meeting. Ghimire and Bertaula have committed to pass the resolution. A meeting of the Special Committee of Inquiry was held after receiving a commitment that he would be made the chairman and not the
coordinator. Pariyar informed that the agenda was discussed in the meeting. "The meeting has passed the internal procedure and discussed the agenda, it has been decided to discuss the minutes of the discussion on Section 82 of the Civil Bill in the State Arrangements Committee and discuss it in Friday's meeting," he said.
