A seven-member special committee will be formed to investigate the cheating in the provisions related to the 'cooling off period' of the Federal Civil Service Bill. Speaker Devraj Ghimire is preparing to announce a special committee in the meeting of the House of Representatives on Monday afternoon.

According to Rule 180 of the Rules of the House of Representatives, a special investigation committee is about to be formed. Rule 180 provides that a special committee may be formed in the House of Representatives for bills or other work of a special, sensitive or serious nature. The mandate of the committee to investigate the cheating in the civil service bill will also be announced in the House of Representatives meeting on Monday. 

According to an official of the Parliament Secretariat, the committee named "Federal Civil Service Report Error Investigation Special Committee" will have a mandate to investigate and recommend action against the officials involved in maintaining the provision in the bill that makes the provisions related to "cooling off period" ineffective. The committee will also suggest the precautions to be taken to prevent such incidents from happening again.  It is agreed that the

committee will consist of 2/2 members from the ruling Congress and UML, and 1/1 member from the opposition party Maoists, RSVP and RPP. Chief Whip Shyam Ghimire has given verbal information to Speaker Ghimire about Congress sending to Whip Sushila Thing and MP Jeevan Pariyar in the committee. RPP has made MP Roshan Karki a member of the committee. UML, Maoists and Raswapa said that they will send the names of the members who will be in the committee on Monday. All the five parties are ready to give the responsibility of the coordinator of the

committee to the Congress, the largest party of the ruling party. The Speaker and Chief/Chief Whips of major parties have agreed to give the investigation committee time to submit the report within 21 days from the date of formation. 

The State Law Committee unanimously decided in Section 82 (4) of the Bill on Civil Service that 'an employee who has resigned or retired from civil service or other government service shall not be appointed to any constitutional or government position before the completion of two years from the date of retirement'. After making this arrangement, section 82 (4A) of the original bill should be removed and the report should be submitted to the House of Representatives.

In order to make the provision related to 'cooling off period' made by the State Law Committee in Section 82 (4) ineffective, it was placed in Section 82 (5A), in which a person who has retired from a special or first-class position under the gazette of the Government of Nepal cannot be appointed within 2 years from the date of retirement to a position other than 'constitutional or diplomatic appointment and any other appointment made by the Government of Nepal.' 

Only after the bill was passed by the House of Representatives with the report, it was revealed that the provision of 'cooling off period' would become ineffective. Since then, there has been criticism of the functioning of the Parliament from inside and outside the Parliament. In the civil service bill, the provision related to 'cooling off period' is becoming the most complicated. The Chief Secretary, General Secretary of the Parliament and secretaries have been lobbying the opposition ever since the State Administration Committee was preparing to put in place the system of 'cooling off period'. Even after the committee passed the report by unanimous decision, they met Prime Minister KP Sharma Oli, Congress President Sher Bahadur Deuba, Speaker Ghimire, National Assembly Speaker Narayan Prasad Dahal and others and pressed to remove the 'cooling off period' system.

Chairman of the State Administration Committee, Ramhari Khatiwada, has said that after the formation of the inquiry committee, he will not take any action as the chairman of the committee. He said that he will not take the facility that the chairman will get and will wait for the conclusion. I had taken the stand that there should be a cooling off period of at least 2 years in the Civil Bill. I am also the one who requests the speaker to form an inquiry committee after a dispute,' Khatiwada said, 'I will not know about the committee after the inquiry committee is formed.' 

The state administration committee secretary, Suraj Kumar Dura, has resigned after the investigation into the mess in the civil service bill. Even after he was promoted to the Secretariat Secretary of the Federal Parliament on 31st of June, he was again in charge of the State Order Committee. Due to his experience and playing an important role in finalizing bills like anti-corruption, citizenship, and civil affairs, Dura was re-introduced to the responsibility even after he was promoted to secretary to finalize the bills of Nepal Police and Armed Police.
