The House of Representatives is going to form a special committee to investigate the mess made in the report of the Federal Civil Service Bill. A meeting with heads/chief whips of various parties led by Speaker Devraj Ghimire on Saturday concluded to form a parliamentary special committee.
Why was there a disturbance in the writing of the report on the matter that the State Order and Good Governance Committee had unanimously agreed upon? Mahesh Bertaula, the chief whip of the ruling UML, said that the conclusion of the meeting to form a special committee to conduct necessary studies and research on this matter.
The committee unanimously decided to keep the provision of 'cooling off period' in the bill so that the employee will not get constitutional or government appointment for two years after resigning or retiring from government service . The provisions that were used to make the provision in the bill ineffective were kept in the report of the committee . It has been passed by the House of Representatives. Only after it was passed by the House of Representatives, it was revealed that something different from the committee's decision was put in the report and it was passed. It has increased the criticism of the work of the Parliament inside and outside the Parliament. After serious questions were raised about the parliamentarians and employees involved in the legislative work, the pressure for investigation increased.
The chief whip of the main opposition party Maoist, Hitraj Pandey, said that an investigation is needed on the mess made on the matter that the committee unanimously agreed upon. He informed that an agreement has been reached between the Speaker and the parties to form a special committee to investigate the same. There is one consensus. It is different when the report comes. "That is not acceptable," he said, "The main task of the parliamentary special committee will be to investigate how the mess happened." He said that it was decided to form a 7-member committee.
The committee will be formed according to the special committee provisions in Rule 180 of the Rules of the House of Representatives. There is a provision in that rule that a special committee can be formed as needed in the House of Representatives for bills or other tasks of a special, sensitive or serious nature. UML's chief whip Bertaula said that an agreement has been reached between the speaker and the chief/chief whips of the party to form a special committee based on the same rules. The committee will be announced from the meeting of the representative assembly held on Monday.
Maoist chief whip Pandey informed that the names of parliamentarians in the committee, coordinators and duties of the committee will be decided at the meeting of the executive committee at 11 am on the same day. A committee is going to be formed with 2/2 members from Congress and UML and 1/1 member from Maoist, RSWP and RPPA.
The federal civil service bill is among the bills that have not been passed by the parliament even after a long period of time. The government registered the bill in the House of Representatives on 2nd February 2080. After a period of more than two years, the State Order and Consultation Committee has agreed on the said bill. The report of the bill passed unanimously by the committee was submitted to the House of Representatives on June 1. The Assembly passed it on June 15. After being passed, the bill has been dragged into controversy.
The bill brought by the government did not have any provision about the 'cooling off period' of employees. The committee unanimously decided to make a provision that "Civil servants or other government employees who have resigned or retired from service will not be appointed to any constitutional or government post before the completion of two years from the date of retirement". However, in the bill passed by the House of Representatives, another section has been added to break it. In the added section, it is said that the provision of two-year 'cooling off period' will be applicable only to posts other than constitutional or diplomatic appointments and any other appointments made by the Government of Nepal. It has made the agreement made by the committee ineffective .
The meeting of the State Order and Good Governance Committee on Wednesday has asked the Speaker to form a committee to investigate the issue of making the cooling off period ineffective.
After the committee prepared to keep the system of 'cooling off period' for the employees, more than a dozen secretaries from the chief secretary, general secretary of the parliament increased the pressure not to keep it .
