”It is unfair to prosecute only the doctor”

Nepal Medical Association has expressed serious objection to the decision of the consumer court in the case related to medical practice. The association said that the medical profession is a very sensitive, scientific and ethical service and it is unacceptable to evaluate it like any other profession.

In the press release issued by the association, it is stated that medical services are not consumer goods and it is not fair to blame only the doctor for the complications or adverse effects of the treatment. The association claims that such decisions will spread distrust in the health system and frighten doctors. A few days ago, the consumer court decided to take action against Grandi Hospital and doctors with compensation of 57 lakh 19 thousand rupees for negligence in treating patients.

Similarly, the consumer court decided to pay compensation of Rs 1.45 million to Himal Hospital and the doctors working there. In a statement issued by the general secretary of the association, Dr. Sanjeev Tiwari, it has been demanded that the legal intervention of the consumer court, ignoring the regulatory bodies like the Nepal Medical Council, has created confusion in the medical field and such matters should be evaluated only by the Nepal Medical Council. The association has requested the consumer court to review the decision and to pay immediate attention to the relevant agencies including the Ministry of Health.

Emphasizing the need to ensure the right of doctors to work in a safe environment, the association has warned that if such an environment does not exist, there may be a serious impact on health services. In addition, the association is of the view that any attempt to force doctors to work in an atmosphere of unnecessary fear in order to affect public health is unacceptable. According to the association, the attention of the Prime Minister, Home Minister, Minister of Industry, Commerce and Supply, Minister of Law, Justice and Parliamentary Affairs, Minister of Health and Population, Attorney General and other stakeholders have been drawn to this matter.
