The National Human Rights Commission has drawn attention to ensuring access to justice for victims of torture.
The commission has requested the government to refrain from inhumane and criminal acts like torturing people, to punish those involved in torture, to ensure access to justice for victims of torture and to be sensitive in implementing the recommendations of the commission.
Regarding the International Day for Support of Victims of Torture, Joint Secretary and Spokesman of the Commission, Tikaram Pokharel, issued a statement on Thursday and said that despite various legal and structural arrangements, the practice of torture in Nepal has not been completely ended.
The National Human Rights Commission has been regularly monitoring and investigating cases of torture since its inception. Article 22 of the Constitution of Nepal states that in the case of torture, physical or mental torture shall not be given to a person arrested or detained or treated in a cruel, inhuman or degrading manner and such act shall be punishable according to law and the victim shall be compensated.
The Criminal Code, 2074 defines torture as a criminal offence. The Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, 1984, to which Nepal is a party, prohibits the act of torture and calls such an act punishable.
The commission has also called on not to torture any person under any pretext as it is prohibited by the constitution and law.
