A group of editors has demanded the cancellation of the arrest warrant issued against journalist Dilbhushan Pathak.
35 editors issued a joint statement on Saturday and demanded the cancellation of the arrest warrant against the reader, drawing the attention of the state to follow the provisions made by the law regarding freedom of thought and expression. The editors of
have also objected that the arrest warrant was issued against journalist Dilbhushan Pathak by misusing the law made for different purposes . Also, they said that it is regrettable to try to arrest journalists by mobilizing the police force.
There is a clear legal system and practice that anyone who presents unverified, unclear content while exercising freedom of thought and expression can be sued in the Press Council and the court. But it is regrettable to use the provisions of the law made for a different purpose and try to arrest the journalist by mobilizing the police with the force of power", the statement said. The group of
editors has said that the law has been misused before and a discriminatory situation has been created where one has to go to the ordinary civil court for redressal but for the powerful, the police arrest them. In addition, the editors have also drawn the attention of the government and parliament to the process of revising the wrong provisions placed in the Electronic Transactions Act by curtailing fundamental rights such as freedom of expression.
Similarly, the editors have expressed serious disagreement with the recent orders of the Kathmandu District Court regarding the news published in online news portals including Bizmandu.com, Nepalkhabar.com.
'The order given by the District Court Kathmandu to remove such materials without giving the relevant media organizations a chance to present their statements and evidence on the content published online has also raised questions about the right to a clean hearing.
is not only about removing news content without hearing, but the constitutional right of not being banned before publication has also been violated by the order to 'do not publish news'. We draw the judicial leadership's serious attention to this," the statement said.
