Supreme Court order to Congress General Minister Thapa not to speak about the case pending in the court

The Supreme Court has issued an order to the ruling Congress General Minister Gagan Thapa not to comment on the case pending in the court. The order was issued on Tuesday by a joint bench of Supreme Court Permanent Chief Justice Sapna Pradhan Malla and Justice Nityanand Pandey.

The Supreme Court issued the order while hearing the petition filed by advocate Anantaraj Luintel and others against Thapa for contempt of court.

Referring to the 'restrictive phrase of Article 17(2) of the Constitution of Nepal, which states that personal freedom is not absolute, and the reference to Article 105 of the Constitution of the Federal Parliament, which states that matters that adversely affect the delivery of justice in relation to cases under consideration in the court, the Supreme Court has ordered Thapa, 'Considering the sensitivity of the judicial process of fair justice in the case under consideration in the court, the action of giving any expression that may adversely affect the case under consideration before the court Don't do/don't do .'

Likewise, the Supreme Court has also issued an order to Thapa to submit a written answer as to why action should not be taken for contempt of court.

Thapa raised a question in a program held in Kathmandu saying that the appointments made in the Constitutional Council have been under consideration in the court for 4 years . A writ of contempt was filed in this regard.
