The National Independent Party concluded that the chairman Ravi Lamichhane was arrested against the legal process. The meeting of the Secretariat which started on Wednesday has decided that the arrest of Lamichhane on Chait 22 is against the legal procedure.
According to Manish Jha, Acting Spokesperson of RSVP, the secretariat meeting has decided that the order given by the High Court was implemented without completing the legal process.
'While the High Court of Tulsipur has respectfully accepted the order of the Butwal bench and has publicly announced the arrest itself, the district court did not initiate the process for the implementation of the High Court's order. We believe that the arrest of President Ravi Lamichhane by the police on the 22nd of Chait is against the proper procedure of the law.' His detention for two days and three nights is automatically illegal as he has been granted bail.'
RSVP has also criticized the role played by the police administration in arresting Lamichhane. The RSVP Secretariat says that the police arrived at Lamichhane's house to arrest him without completing the legal process.
'District Court Rupandehi did not start the process and took action to arrest the President Lamichhane, the actions of the police in his residence are more objectionable . Activities such as entering the house without taking the basic documents determined by the law and even a court order, delaying it only after being asked by the Speaker Lamichhane, arresting for investigation in a case that has been ordered by the High Court, and asking for the 'last wish' of the high-ranking police officers, not only show the unprofessionalism of the police, but also undermine the rule of law,' said the RSP Secretariat.
The RSVP claims that the arrest has proved that the state apparatus has retaliated against Chairman Lamichhane . The meeting also demanded the National Human Rights Commission to investigate the truth and take action against the culprits regarding the state's brutal revenge against Party Lamichhane and the incidents of police repression and human rights violations against him. The matter was also discussed in the secretariat meeting.
