Despite having about two-thirds in the House of Representatives in its favor, due to the tight arithmetic of the National Assembly, the government has not been able to put the ordinance on the agenda of both houses of the Federal Parliament for approval.
The Janata Samajwadi Party (JSP), which is in a decisive position in the National Assembly, has put the government in trouble after Nepal made a pre-condition for withdrawing the land ordinance. The JSP, Nepal Union and the state government, which gave a vote of confidence to the Prime Minister, are not participating anywhere . Although there is a strong majority in the House of Representatives, its 3 seats have become decisive for the government to approve the ordinance from the National Assembly. The position of the Democratic Socialist Party (LOSP), which is participating in the union government, is also not in favor of the government. Representing one seat in the National Assembly, he has taken the stance that the Land Ordinance should be returned like JSP Nepal.
There is a constitutional provision that the ordinance must be passed by both the House of Representatives and the National Assembly. The Ordinance was once on the agenda of the House of Representatives for approval, but Speaker Devraj Ghimire removed it from the agenda at the request of the government after the arithmetic of the National Assembly was not safe.
The government was forced to proceed with only five other ordinances after the party supported and participated in the government protested about the ordinance related to land . This decision was taken from the ruling party meeting held by Prime Minister KP Sharma Oli on February 3 in Baluwatar. After the all-party meeting in Baluwatar, the government had put the land ordinance on hold and was preparing to move five ordinances forward. However, since JSP Nepal President Upendra Yadav has taken the stance that it should be withdrawn instead of being on hold, the government is not able to proceed even with the five ordinances.
Senior Vice President Raj Kishore Yadav of JSP, Nepal, who will not support the other five ordinances if the Land Ordinance is not withdrawn. The first 'condition' of our party is to withdraw the land ordinance. If that happens, we are open to help with other ordinances. There are some things that need to be amended. It can be fixed by amending the replacement bill, Yadav said, but the ordinance related to land should not be put on hold and withdrawn. This stand is the precondition of our party.'
The ruling party Congress and UML leaders said that withdrawing the Land Ordinance may raise moral questions on the government and made a strategy to put the Land Ordinance on hold and proceed with the other five ordinances. After JSP, Nepal made a pre-condition that the ordinance should be withdrawn, the government is also discussing other options to ensure numeracy. He is increasing pressure on the United Samajwadi Party, which has 8 MPs in the National Assembly. The leaders of the two ruling parties have been urging the parliamentarians of the United Socialist Party to vote in favor of the ordinance. Regarding the
ordinance, there are two types of opinion within the integrated socialists . A CPN (S) leader said that although some MPs, including Madhav Nepal, were against it, more than half of the MPs were in favor of the ordinance. The parliamentarians who are trying to form a separate party by dividing the party are now in favor of the ordinance. Kisan Shrestha, MP of S, says that it is not recognized that the opposition should not cooperate with the ordinance which is in the interest of the country.
'If the party does not issue a whip, does not give instructions, in that case I will be in favor of the ordinance . Even within the party, there is a voice in favor of it. If you are in the opposition, you don't have to oppose every law. There is no need to oppose the issues that are in favor of the country and the people by saying that we are in the opposition. My belief is that it should be supported," Shrestha said to Kantipur. "In my personal opinion, the ordinances brought now are good. If something needs to be adjusted in the content, it can be adjusted through the replacement bill. But there is no need to oppose it. He said that the party is still discussing what to do. Another minister of the government said that the government is doing the work of discussing with the leaders of S to support the
ordinance and moving forward the bill on political parties in parallel. The government is preparing to take the bill to the parliament by facilitating the division of parties.
'We are doing our homework to advance the previously prepared ordinance in the form of a bill so that parties can be split easily,' said the minister, 'for that, the bill will go to the parliament within a few days.'
According to him, the government is preparing to bring an amendment proposal so that 40 percent of the members of the parliamentary party or the central committee can split the party by revising the provision in the existing law that requires forty percent of both the parliamentary party and the central committee in the bill. The government is trying to remove the existing provision that once a party is divided, it cannot be divided for five years. A provision that the new party formed by division cannot merge with any party within the term of the parliament will be proposed in the bill. In order to become a big party, Prime Minister Oli wants to divide the Congress and this proposal is going to be proposed in the bill.
However, Shrestha claimed that there was no discussion about party division. It is my personal opinion that the current ordinance should be supported if we want to work with honesty from all sectors for the economic, social and landless people. If the party issues a whip, I should stand in favor of it," he said. "Working with good intentions can solve many problems in the country."
