After not getting the support of some ruling parties, the government will not proceed with the land ordinance immediately. The meeting of the ruling party held at the Prime Minister's residence, Baluwatar, on Saturday morning decided to leave the land ordinance and proceed with the process of passing five other ordinances.
According to the Minister of Home Affairs, Ramesh Akhtar, there will be further discussion on the land ordinance as there are different views among the ruling parties. "It has been decided to proceed with the process of accepting the remaining five ordinances from both houses of the federal parliament," he told Kantipur, "probably five ordinances will be presented by February 6."
Both the meetings of the House of Representatives and the National Assembly have been called on Sunday. As the agenda for direct question and answer with the Prime Minister has been kept in the House of Representatives on Sunday, the ruling party is preparing to present the ordinance for approval in the next meeting.
Despite giving a vote of confidence to Prime Minister KP Sharma Oli, the government was in trouble after the JSP Nepal formally decided to reject the land ordinance, which did not participate in the government. After the decision of Jaspa Nepal, LOSPA, a member of the government, also decided not to support the land ordinance.
Although Congress and UML have a comfortable majority in the House of Representatives, Jaspa Nepal is in a decisive position in the National Assembly. The 59-member National Assembly has 16 members from the Congress and 10 from the UML. JSP Nepal has 3 MPs and LOSPA has 1 MP. One of the 3 MPs nominated by the President is sure to support the government. There is a constitutional provision that the
ordinance must be approved by both houses of the Federal Parliament, if it is not approved, it is automatically repealed. The government was preparing to approve all 6 ordinances simultaneously. A Congress official said that even though Prime Minister Oli and Congress President Sher Bahadur Deuba tried to reach an agreement, they were forced to keep the ordinance related to land. JSP Nepal and LOSPA have been saying that they will support general amendments to the other five ordinances through a replacement bill.
Jaspa Nepal did not participate in the meeting held in Baluwatar on Saturday morning. From the meeting place, Home Minister Ramesh Akhtar telephoned Jaspa Nepal President Upendra Yadav and First Vice President Raj Kishore Yadav, who were outside Kathmandu, and asked for their support in the land ordinance. After both leaders informed that they could not support the land ordinance, they immediately stopped it and informed that only five ordinances would be moved forward.
JSP Nepal spokesperson Manish Suman said that the land ordinance cannot be accepted even on the condition of amending the replacement bill. The Home Minister called Party President Upendra Yadav and Vice President Rajkishore Yadav. We reiterated the decision of January 29, that is to say that five other ordinances should be amended in the replacement bill, but the land ordinance should be withdrawn," Suman told Kantipur.
Among the 6 ordinances brought by the government, the ordinance brought to amend some of the Nepal Acts related to cooperatives was issued by President Ramchandra Paudel on January 14. On December 26, the government recommended to the President the Ordinance brought to amend Acts 11 on improving the economic and business environment and increasing investment, 13 on promotion of good governance and public services and 3 on land and forest and to amend the Economic Procedures and Financial Responsibility Act, 2076 and the Privatization Act, 2050. Among them, 4 ordinances were issued by President Paudel on January 29 and the land ordinance on January 2.
The top leaders of Congress and UML have been expressing their displeasure that the ordinance was brought without discussion not only with other ruling parties but also within their own party. The content of the Land Ordinance is deeply resented by the ruling Congress and other parties. Leader Shekhar Koirala's party has been objecting to the government and the leadership of his own party saying that they are trying to deceive the small parties by 'bargaining' for the approval of the land ordinance.
According to Abdul Khan, Vice President of Janmat Party, in the Baluwatar meeting, Prime Minister Oli asked for help by saying that the land ordinance was brought with the contents of what the then government was trying to bring. "Since there is no consensus among the ruling party, it has been agreed to proceed with only five ordinances after further discussion in the working group," said Khan. According to him, it has been decided to form a working group with one member of the ruling party to reach agreement on the land ordinance.
Minister of Home Affairs also said that there was a discussion to form a working group on land related ordinances. According to the feeling of the ruling party, the land ordinance will be moved next time by amending the replacement bill.
JSP Nepal and LOSPA have been saying that the ordinance related to land will help the land mafia to clear the forests of Terai/Madhesh and it will cause crisis and cannot be accepted under any circumstances. They also understand that the land mafia will abuse the provision that allows them to sell land in excess of the limit and distribute the forested land in the name of the government to the landless.
In the Ordinance brought by the government, provision has been made to provide landless Dalits, landless squatters and unorganized people with land mentioned in Gauchar, Haat, Hatghat or market in survey book or cost. Similarly, by amending Section 3 (b) of the National Parks Act, 2029, it has been arranged to re-mapping the land designated as forest, forest area or Bhutan area and separate it from the forest area and bring it under the name of the Government of Nepal.
"There is an objection that the government has amended the law through an ordinance so that even forest land can be distributed to squatters," said a Congress leader, "Since the ordinance is not in a position to be approved immediately by the National Assembly, there is a possibility that it will be brought as a bill."
