The public prosecutor's office did not file a case because the police submitted an investigation report with the opinion that a case should be prosecuted in the case of fraud.

District Public Prosecutor's Office Kathmandu has acquitted Mohan Bahadur Bista, the leader of the ruling UML, who was arrested on charges of fraud in land transactions. Although the Kathmandu police submitted an investigation report with the opinion that a case should be prosecuted for fraud, the public prosecutor's office left Bista in normal attendance without filing a case in the court.

Rajendra Koirala of Tarakeshwar Municipality-8 filed a complaint at District Police Complex Kathmandu against 4 people including Bishta for defrauding about 80 million rupees without passing the land. After that, Bista, who was arrested from Maharajganj (Shankhpark) on December 27, was detained and investigated by the police. After completing the investigation, the police submitted the report with opinion to the district attorney's office on Tuesday (January 8). But according to the investigation report, the public prosecutor's office did not prosecute the case.

Kamu co-attorney of the Public Prosecutor's Office, Kathmandu, Ramhari Sharma Kafle, said that the appearance was postponed due to the fact that both sides had entered into an agreement. "This fraud can be settled with a settlement agreement, that's why Bista was released in court. There is no malice in it." According to the police report, the case against the accused has to go to court, but why is it, a letter was sent to the police to drop it at the time of appearance,' he said Bista, who was elected as the ward chairman of Metropolitan City 4, became a rebel candidate in Kathmandu-5 (1) after not getting a ticket from UML in the 2079 state assembly elections.

District Attorney Uday Chandra Adhikari had written a letter to the police to release Bista from the case pending appearance. In the letter, it was mentioned that 'even if he left the presence, he did not destroy the evidence'. A police officer said that it is wrong to leave the accused with the claim that the evidence will not be destroyed when the accused is released from custody when the demand for imprisonment and fine has been taken according to the Criminal Code. "It is not good to make a decision in favor of the accused after the investigation by the police, ignoring the report submitted for prosecution, it automatically raises questions about the impartiality of the government," said the police officer who spent a long time in the investigation. The report should have been returned or the case should have been filed in the court as per the demand It was mentioned in the complaint that he had given permission to buy the land of Dharamsthali after investing, but later did not return the permission and cheated. According to the details mentioned in the complaint, Bishta had obtained permission from Koirala to sell the land of lot number 191, 189, 141, 142, 124, 125, 126 and 100 of the former Kathmandu Dharamsthali Gavis-1 (currently Tarakeshwar Municipality). He took 5 crores of rupees without any documents. Then 1 crore 97 lakh was added. After that, the Koirala side says that 20 million 10 lakhs were spent on securing the land and putting up a wall.

Bishta argued with Koirala saying that there was no dispute over the land, no one had stopped it and there was no problem. But Koirala found out that he had been cheated when it was revealed that the land was involved in a dispute while Bishta was leaving to do the naming . It has been revealed that Mohan Bahadur Bista along with his brother Ravit Bista, Sulochana Kandel of Kathmandu Tarakeshwar and Shanti Pathak who lives in Tarakeshwar (Manmaiju) and Dhading Salyantar are trying to sell the disputed land. Koirala filed a police complaint against all four. After that Mohan Bahadur was arrested but 3 others were absconding.

The police mentioned in the investigation report that the offense was confirmed as claimed in the complaint. In the report submitted by the police to the public prosecutor's office, it is said that, out of the total amount of 97 million including the amount taken from Jaherwala under false pretenses of 50 million, later added by Zaherwala at 197 million and 20 million spent to prepare the land, the amount taken by Jahewala under false pretenses from other people is 12 million. Since it has become clear that the amount of 78.7 crores that was deducted and remained was defrauded, the defendants Mohan Bahadur Bista, Ravit Bahadur Bista, The act of Sulochana Kandel and Shanti Pathak was confirmed to have committed the offense of fraud defined in sub-section 1 and 2 of section 249 of the Civil Code 2074. However, ignoring these facts, the public prosecutor's office did not file a case.
