National Independent Party MP Sobita Gautam has said that when the winter session of the Federal Parliament is to be convened, the government is doing something that should not be done in the parliament by bringing one ordinance after another. He said that the government should play the role of bringing ordinances in this way until the President stops them.
Gautam says that it is not right for the government to leave the right way of making laws through the Parliament and bring an ordinance. The three organs of the state, the legislature, the executive and the judiciary, have been divided into their respective functions by the constitution. The principle of separation of powers says that one should not interfere with the work of the other,' she said, 'Law making is done by the Parliament according to the constitution. Now it is seen that the government is trying to run the state through an ordinance by locking the parliament.'
MP Gautam says that the government has got the right to introduce an ordinance in the constitution to make legal arrangements that should not be made immediately when the parliament session is not in session, but it is being misused. "If mandatory work is to be done, the constitution provides for bringing ordinances to remove difficulties, but looking at the recent activities of the government, it is easily bringing ordinances as if it is a regular and natural process. This is a practice that should not be done in the parliamentary system,' she said.
Gautam also says that it is unfortunate to try to run the state through an ordinance when the Congress, the largest party in the parliament, and the UML, the second largest party, have a two-third majority government. It is a misfortune in political history that the government formed by this grand coalition practices ordinance rule. If this process is considered natural, the legitimacy of the Parliament will be questioned,' she said, 'If any law is urgently needed in the Parliament, the bill can be passed on the fast track . However, the government is bringing an ordinance in this way by deceiving the representatives elected by the people.'
MP Gautam also says that the President should stop the government which is unnaturally recommending one ordinance after another as the guardian of the state. "The president should play a role in deciding whether to stop the ordinance brought by the government as a guardian of the state." They should stop bringing the ordinance and call the session of the parliament. Legislation and raising the voice of the people should be done through the Parliament,' she said.
MP Gautam says that law-making through parliament will slow down, but the government trying to run the country through ordinances is an act that raises questions about the parliamentary system and practice.
