87 people found guilty in Tikapur land embezzlement

A special court has convicted 87 people in embezzlement of government land in Tikapur of Kailali. The bench of Special Chairman Justice Teknarayan Kunwar and Justices Tejnarayan Singh Rai and Ritendra Thapa has also decided to return about 7 bighas of land, which was transferred based on the deed documents.

 Thursday's judgment also mentions that a fine of 13 lakh 7 thousand 300 rupees will be collected from the person found guilty. 

Tikapur-1 located in Tikapur Nagar Bikas Committee located in Tikapur-1 with the connivance of officials and party representatives including the then chairman of Tikapur Nagar Bikas Committee and party representatives and forged documents to transfer the rights to relatives and others in the name of the committee's land, the Abuse of Authority Investigation Commission filed a special case in January last year.

It is believed that corruption has occurred due to corruption and collusion of even the officials of the committee, which is contrary to the original purpose of the project implemented by the government from 2028 with a long-term vision, with the aim of providing water at a reasonable price with priority given to the deprived groups with low income.

Arju Rana Deuba, the wife of Congress president Sher Bahadur Deuba, was directly involved in the land case and there was a voice that a case should be filed against her as well. According to the authority, Arjubela was brought under the scope of investigation and 249 people were made defendants and filed a case in the special court on January 25 last year.

Only 87 of them were found to be involved in land embezzlement. The special decision is to confiscate the land as claimed by the authority.

Joshi was appointed by the government on May 20, 2065 as the chairman of the committee formed in 2028 for the purpose of giving land to the landless. After becoming the chairman, Joshi issued a notice asking those who applied for land registration and were selected and proved to be land owners but did not cancel the filing, to come and cancel the filing.

All the records previously prepared by the committee were burnt on May 8, 2058 when the Maoists set fire to the office of the committee. That is why Joshi's relatives and political representatives of Congress, UML and Maoists also made fake documents in their names and registered the land. It is mentioned in the court verdict that at least 1 and at most 4 plots of land were registered in the name of individuals by creating fake documents.  Khadga Bahadur Shah, deputy head of Tikapur municipality, who represented the party in the

committee and transferred the land to his name, has also been found guilty. The Maoist leader has been sentenced by a special court to 3 months imprisonment, confiscation of registered land and a fine of 1.3 million.

Congress local representative Yama Bahadur Bam and UML's Shyam Khatri have also been found guilty. They are also given the same punishment. Devendra Bahadur Kunwar, Padmaraj Neupane, Khadga Bahadur Shah, Ambadatta Joshi as well as planning chief Bal Bahadur Kadayat, measuring officer Man Bahadur Chand, Malpot officer Jai Bahadur Bista among others who have been found guilty.

It is found that the officials of the city development committee headed by the respondent Netra Prasad Joshi and the coordinators and members of the sub-committee formed under the said committee have recommended the petitioners who submitted false and fake proof documents to the petitioners who have been rejected.

It seems that the coordinator of the sub-committee Ganesh Singh Rawal and some members recommended to get land in the name of close relatives and family members There is also a special conclusion that the committee has recommended the cancellation of the filing on the basis of its own decision without presenting it to the board for decision. 

A complaint was filed with the Authority on Chait 20, 2078 regarding land embezzlement in Tikapur. After investigating the matter, the authority prosecuted the officials including the then chairman of the Tikapur Development Committee, the officials of the sub-committee formed by the committee, some employees of the Land Registry Office and the Surveyor's Office, and the first-level purchasers who canceled the land registration from the committee and other purchasers who purchased the land from them as defendants. The special has given immunity to the second level purchasers saying that there is no involvement in the contract documents. 

Lalit Tamrakar, chairman of development committee working from 2067 Chait 22 to 2068 October 15 and 2069 May 17 to 2070 May 25, and officials of the sub-committee formed under his chairmanship and Dhijraj Regmi, chairman of the committee working from 2070 May 26 to 2071 Chait 7, are also not involved in the crime. , planning chief Jhappar Bahadur Vick, surveyor Ganesh Bahadur Bam, buyer Dhaniram Bhandari, sub-engineer Netra Bahadur Rawal and field supervisor Devilal Ghimire have been acquitted because they did not appear to have a decisive role in the alleged crime.
