It has been decided that all those involved in the contempt of court case against the content broadcast/published as 'Dark File' on 'Sidha Kura' dotcom will be sentenced to imprisonment.
The 9-member full bench of the Supreme Court sentenced Rajkumar Timalsina, who made 'fake audio', to 6 months and to Yuvraj Kandel, publisher of Siddha Kura Online, and executive editor Naveen Dhungana, to 3/3 months imprisonment. In the case of
online, a fine of Rs 5,000 has been set. It is mentioned in the judgment that the penalty of 5000 fine will be waived if he apologizes online. It is mentioned in the judgment that if the publisher and editor of the
issue a written application and apologize for the broadcasted content, the sentence will be reduced and will be maintained for 7 days. In the case of Timalsina, it has been decided that the prescribed sentence must be paid .
Chief Justice Vishwambhar Prasad Shrestha and judges Prakashman Singh Raut, Sapna Pradhan Malla, Prakash Kumar Dhungana, Hariprasad Phuyal, Nahkul Subedi, Vinod Sharma, Mahesh Sharma Paudel and Balkrishna Dhakal decided the case.
'Sidha Kura' had prepared and broadcasted and published misleading propaganda material about Supreme Court judges, media operators, lawyers. The Supreme Court Deputy Registrar Govinda Ghimire filed a contempt of court case against the court saying that the act had a serious impact on the administration of justice.
After the police investigation confirmed that the audio material prepared by 'Sidha Kura' was misleading and untrue, the District Public Prosecutor's Office has already filed a case against Timalsina, Kandel and Dhungana in the District Court of Kathmandu for three offenses including cyber crime. The court has released all three people on bail. With the verdict of the Supreme Court on Sunday, all three people have to pay the punishment.
