The Ministry of Labour, Employment and Social Security has called for suggestions in the draft of the new immigration policy prepared with the aim of making labor migration safe, orderly and dignified and contributing to internal employment and prosperity.

A team led by labor expert Ganesh Gurung submitted the 'Labor Migration Policy Draft-2081' to Labor Minister Sharatsingh Bhandari last Sunday. Minister Bhandari said that the draft will be finalized after receiving suggestions from stakeholders.

With the conclusion that the foreign employment policy prepared in 2068 cannot address the current situation, the government is about to bring a new labor immigration policy. "We are going to bring a comprehensive immigration policy to deal with all the steps from leaving home for foreign employment to resettlement," said Labor Minister Bhandari. He informed that the goal of the new policy is to end forced labor migration by making labor migration profitable and promoting self-employment and entrepreneurship in the country. According to Minister Bhandari, since there is no situation in which the available manpower can be employed in Nepal by immediately establishing new industries in the country, there is a need to develop well-informed, skilled, competitive and professional labor force according to the demand of the international labor market. 

The proposed policy covers issues such as ensuring information, services and good governance in labor migration, managing foreign workers working in Nepal. The draft also mentions that the Foreign Employment Act 2064 and the Foreign Employment Regulations 2064 will be amended to make the labor immigration process simple, transparent and worker-friendly. It is also mentioned in the draft that the strategy of adopting the law of the whole government and society will be taken while creating and modifying the policy and legal structure related to labor immigration. 

It is said in the draft that a strategy should be adopted so that the expenses incurred in the labor immigration process, which has been the most controversial subject for a decade, should not be borne by the workers. In the draft, the expansion and effective implementation of the system in which the employer bears the expenses incurred during labor migration, a clean and fair recruitment process will be adopted, an effective monitoring mechanism will be created with rewards and punishments for employers and businessmen who provide services related to labor migration, and the system in which the employer will bear the expenses of the labor It is mentioned in the bilateral labor agreement with the destination country, that foreign employment professionals will be held accountable to make the recruitment process of workers transparent, fair and ethical. 

Former Secretary Purnachandra Bhattarai said that it is necessary to completely revise the Foreign Employment Act to simplify foreign employment management. This law cannot be amended by sweeping amendments. It should be completely revised to address the current market,” he said. Rajendra Bhandari, President of Nepal Foreign Employment Professionals Association, says that the policy of "employer pay model" should be adopted after looking at the employers. There was no problem with the employer bearing all the expenses. But if the employer does not bear all the expenses, a policy should be adopted to allow the workers to charge service fees,'' he said, 'if 100 percent goes to the employer pay model, the problem will be there.'  In the draft of the

policy, it is aimed to include Nepali workers going/returning to work in India in the labor immigration system. For this, it is said that the data will be kept through the employment service center at the local level and identity cards will be provided gradually and uniformity will be maintained in data collection. Similarly, it is mentioned in the draft to create a suitable model like Foreign Employment Welfare Fund for welfare work of workers going to India. In 2073, the Pushpa Kamal Dahal-led government introduced a policy of recording workers going to India in the border area, but it could not be implemented. Instead, some local governments in the Far West have started documenting workers going to India on their own initiative.  In the draft of the

policy, it is mentioned that the role of the local government and the family will be prioritized at the initial stage of the labor migration cycle. It is also said that workers and their families will be informed about the problems, challenges, possibilities and opportunities that may occur at different stages of immigration, information and information will be given at the local level.  The draft also addresses the issue of making

labor diplomacy and the services it provides effective. It is proposed that the delegation will be equipped with resources, their capacity will be developed, the monitoring system will be made effective and Nepali workers will be easily accessible to the delegation. According to the Auditor General's report, the welfare and protection of the workers has not been able to be done because the Nepalese delegation has not been equipped with resources and facilities.  In the

draft, 'Bilateral labor agreements with labor destination countries should be implemented in such a way as to protect the rights of migrant workers and comply with international laws, identify and develop the skills and competencies of workers according to the demands and trends of the labor market of the destination country, prioritizing internal employment, and the sustainable and It is also mentioned that a policy will be taken to ensure social security through respectful reintegration and to regulate and manage foreign workers working in Nepal according to Nepal's national interests and needs. Gurung, the coordinator of the

drafting team, said that the draft was prepared by taking the suggestions of the concerned parties in all the seven provinces, keeping the interests of the migrant workers at the center. The government has planned to make the next decade the employment decade. To address this, 6 policies, 24 strategies and 113 tactics have been made," he said. "Remittances have reduced Nepal's 42 percent poverty to 30 percent. Now this policy will contribute more to bring it down as well. The draft team consists of Amrita Sharma, Keshav Basyal, Juna Mathema, Manju Gurung member and Deepak Dhakal member-secretary.
