The Ministry of Education, Science and Technology has requested the details of the working committee of the party from the Election Commission to identify teachers affiliated to political parties. The secretariat of Education Minister Sumana Shrestha said that a letter was sent to the Commission on Thursday requesting the details of the executive committee of political parties so that it would be easy to take action against teachers with party affiliations.
"It has been decided to write to the Election Commission asking for the details of all the officials in the executive committees of the political parties at the central, state and district levels," said a press note issued by the Secretariat of Education Minister Shrestha. Spokesperson Keshav Dahal said that the Law and Judgment Branch of the Ministry of Education has written to the Commission and requested the details. He said that the district election office where the complaint was received will also request details and confirm whether the teacher is a member of the party or not and proceed with the action.
After receiving the details from the Election Commission, the ministry said that it will check the details of the teachers, employees and the officials of the executive committee of the political parties. Education Minister Shrestha had decided to take action against teachers of community schools affiliated to political parties on May 4. According to the said decision, the Ministry has instructed the Education Development and Coordination Unit across the country through the Education and Human Resource Development Center to take action against teachers affiliated to political parties. The Center has already written to all 77 district units to remove such teachers from their posts on May 7. In the correspondence sent by Hari Bahadur Shrestha, branch officer of the center, it is also asked to send the information about the removal from the post to the ministry. Reminders have also been sent to all 753 local levels for necessary support and facilitation for the action.
The ministry has also requested to file a complaint about teachers active in political parties. The center has also instructed the units to continue the action process based on the complaints. According to the Ministry of Education, the complaints received so far in the Ministry have also been sent to the relevant district unit for action. 12 teachers have been recommended for action. In which there are also teachers who are district vice presidents of political parties. According to the ministry, some district units have already taken action according to the correspondence.
After the minister's decision, the ministry said that complaints and complaints have been received regarding issues such as teachers and staff working in public schools have membership of various political parties, are in the executive committee, and are convention representatives. The Education Act 2028, Education Regulations 2059, Political Party Act 2073 have prohibited teachers from belonging to political parties. The Ministry has also given instructions to the subordinate agencies for the effective implementation of the Act. The Patan High Court had also issued a mandate in the name of the government on 4th June 2079 for the effective implementation of the said legal system.
Section 16 of the Education Act provides that teachers and employees can be removed from their posts if they are members of the executive committee of a political party. Committees at the central, provincial, district and local levels formed according to the constitution of the party are called executive. In Section 14 of the Act on Political Parties, it is mentioned that the party cannot grant membership to a person holding the position of a professor, teacher or employee of a self-governing institution owned or controlled by the Nepal government, provincial government or local level.
Teachers' unions are active across political parties. Teachers have been involved in party activities through the same association. In the constitution of the parties, there is a provision to select representatives from teachers and professors. Earlier, following the complaint, the Election Commission had directed the Congress and Tribhuvan University to remove the professor from the congress representative.
