Rashtriya Swatantra Party MP Sobita Gautam has said that there has been a problem in the delivery of justice when politics intervenes in the appointment of judges of the Supreme Court. He also said that because judges were not appointed in time in the courts, those who were sent to prison for pretrial detention have been waiting for their turn to hear the case for months.
In Tuesday's meeting of the House of Representatives, MP Gautam said that judges were not appointed on time in the Supreme Court as per the provisions of the Constitution and the only reason for that was the intrusion of politics into the court. "There is a matter to think about in the appointment of judges." We have interfered with politics in the appointment of judges,' she said, 'If one person becomes vacant in the Supreme Court after politics intervenes, we are waiting for four or five people to be appointed there and we are waiting for distribution.'
Member of Parliament Gautam drew the attention of Speaker Devraj Ghimire saying that Parliament should also be serious about the appointment of judges in the Supreme Court. At present, three judges are vacant in the Supreme Court. The constitutional provision of recommending the appointment of a judge one month in advance of the vacancy of a judge has not been followed while appointing a judge in the Supreme Court . Earlier, while 7 judges were vacant, the Justice Council had recommended only 6 posts and left one post vacant . Since the retirement of Supreme Court judges Anil Sinha and Ishwar Prasad Khatiwada, there are currently three vacant posts.
MP Gautam has said that the budget given to the court should also be increased. He said that there is no place to expect much from the court with the budget that the state is currently giving to the court. "The number of those sent to prison for pre-trial detention is also large." We also met people who stayed in jail for twenty months without taking their turn in the case . Why is it not our turn? It seems that we have to be a little more visible here,' she said, 'whom to question? Should we question the court? To which court, which the state allocates less than one percent of the total budget to that court ? It seems that you have to think while giving the budget to the court.'
Likewise, MP Gautam said that the state could not fulfill even the minimum requirements of those kept in prisons and kept those kept there unproductive . He said that those who were sent to the correctional home should be kept in the prison where they will be rehabilitated when they come back to the society tomorrow.
