Rajbiraj Municipality has issued a public notice to vacate the encroached land of the Comptroller and Auditors Office (Kalenika), Saptari, which has been occupied by a person for five decades.

The Commission for the Investigation of Abuse of Authority had written to the municipality 5 months ago to protect the encroached 2 kathas and 14 dhurs of government land there after the investigation. On the same basis, Kolenika had been urging the municipality to vacate the encroached government land as per the decision taken in a meeting convened by Chief District Officer Tubaraj Pokharel on 22 Mangsir 2082.

The municipality has issued a 7-day notice to vacate the encroached land as per the decision of the executive committee held in the municipality last Monday. ‘As per the letter dated 28 Baisakh from Kalenika, 420, to vacate the land encroached by Jagdish Jha’s son Ujjwal Jha and others, a unanimous decision was taken at the meeting of the municipal executive committee,’ the notice issued on Wednesday states. If the land is not vacated within the said period, the concerned person will be responsible for the damage caused by the municipality vacating it.  

According to the landowner Shrestha, 6 kattha 6 dhur land in plot number 90 of Rajbiraj Municipality, former-7 (currently 6) is in the name of Kalenika . However, Jha has occupied 2 kattha 14 dhur land from the southern part of the same land and has built a concrete house/tower and rented out the shutters .

After Kolenika repeatedly requested the municipality to remove the encroachment, Jha had also filed a writ petition in the Rajbiraj Bench of the Janakpur High Court to protect the encroached house/tower. When the writ petition filed by Jha seeking an injunction was heard last Thursday, the court refused to issue an interim order .

A joint bench of judges Narishwar Bhandari and Naresh Kumar Chaudhary had issued an order stating that ‘as an interim order cannot be issued to stop the activities carried out in accordance with the law, there is no need to issue an interim order immediately as demanded.’
