The municipality has not relented even after the Commission for the Investigation of Abuse of Authority (CIAA) decided to vacate the encroachment through a meeting convened by the Chief District Officer based on the decision of Tangal.

It has been more than 3 months since the Rajbiraj Municipality was written to protect the land of the encroached federal office in Rajbiraj Bazaar, Saptari.
However, the municipality has not complied even after the decision of the Commission for the Investigation of Abuse of Authority (CIAA) Tangal to vacate the encroachment by taking a decision from a meeting convened by the Chief District Officer.
According to the decision made on 22 Mangsir 2082, the Comptroller and Auditor General's Office (Kalenika) Saptari, which retains ownership of the land, had written to the municipality on 30 Poush, requesting it to vacate the encroached land. However, the municipality has not yet started the process of removing the encroached land.
According to the landowner Shrestha, 6 kattha 6 dhur land in plot number 90 of former ward number 7 (currently 6) of Rajbiraj Municipality is in the name of Kalenika. However, out of the same land, 2 kathas and 14 dhurs of land from the southern part of the same land have been encroached by the late Jagdish Jha since 11 Falgun 2054 by building a house and a hut. In a letter written by Kolenika to the municipality under invoice number 272, the then Royal Commission for Control of Corruption and the Commission for the Investigation of Abuse of Authority have mentioned that the government property should be protected during the investigation into the matter.
On the same basis, a decision was taken at a meeting convened by Chief District Officer Tubaraj Pokharel and the necessary documents were sent to the municipality. However, even after more than 4 months of the decision, the municipality's non-cooperation continues. Chief District Officer Pokharel said that he will again request the municipality to remove the encroachment. 'The responsibility to remove the encroachment lies with the local government,' he told Kantipur, 'I am requesting again.'
Acting Mayor of the municipality Israt Parbin said that discussions are underway on the issue of vacating the encroached government land and that no decision has been made yet. However, when asked about the nature of the discussions and with whom, regarding the matter that has already been investigated and decided by the Commission for the Investigation of Abuse of Authority, she said, ‘I am currently on a program. I will talk to you later.’
