The corruption case filed by the Commission for the Investigation of Abuse of Authority against 11 people, including the then Chief Administrative Officer of Tirhut Rural Municipality in Saptari, Ramesh Prasad Yadav, has reached the Supreme Court.
The Commission had filed a corruption case in the Special Court on 25 Magh 2080, alleging that they had received more than 1.1 million rupees without doing any work. The Commission appealed against them to the Supreme Court on Friday, saying that the acquittal given by the Special Court on 18 Asad 2081 was flawed.
The Commission alleges that they received 1.19 million rupees more than the amount they had paid for the construction of RCC gates, construction of unfinished buildings, painting and management-related work in the tourism area of Tirhut Rural Municipality-5 in the fiscal year 075/076. The Commission had sought imprisonment and fine against the then Chief Administrative Officer Yadav and Engineer Khurshed Ikram under sub-section (1) of Section 8 of the Prevention of Corruption Act, 2059 BS, and sub-section (2) of Section 19, while the Accounts Chief Sonukumar Soni was sentenced to imprisonment and fine of Rs 735,280 under sub-section (1) of Section 8 of the same Act.
The Commission had filed a case against the then Vice-Chairman of the Rural Municipality Tirthamaya Khatwe, members of the Planning Monitoring Committee Durgananda Yadav, Birendra Kumar Yadav, Bhogananda Mahatman Yadav and Ramananda Chaudhary for the offence under sub-section (2) of Section 19 of the Prevention of Corruption Act, 2059 BS. A demand was made against Consumers Committee Chairman Shivnath Chaudhary, Secretary Devnarayan Chaudhary and Treasurer Chandri Devi for the offence under Sub-section (4) of Section 8 of the Prevention of Corruption Act, 2059 BS, for the confiscation of Rs. 1,19,949 in damages and other damages.
