The controversial issue has reached the court after the village executive meeting approved the resignation of Dinanath Chaudhary, the chairman of Agnisair Krishnasawaran Rural Municipality in Saptari.
Chairman Chaudhary had filed a writ petition in the Rajbiraj bench of the Janakpur High Court, alleging injustice done to him by accepting the resignation that he had not given, and had demanded a mandatory injunction.
In the hearing held on Thursday on the writ petition filed by the rural municipality office and others as defendants, a single bench of the court headed by Judge Subhash Poudel ordered the defendant to submit the grounds, reasons and evidence that the order should not be issued as demanded. The court has ordered the defendant to submit a written response within 15 days, excluding the travel time.
Similarly, both parties have been called for discussions to reach a conclusion on whether or not an interim order will be issued. The court has stated that the presentation has been scheduled for November 1 for the discussion, while the opposition has been ordered to attend the discussion with the decision of the village executive and other original evidence.
Chairman Chaudhary resigned on October 20, and his resignation was accepted at the village executive meeting held on October 18. As per the decision of the meeting, Kalpana Chaudhary, the vice-chairwoman of the rural municipality, has become the acting chairperson.
