The High Court has ordered the submission of the file along with that of Chhabilal Joshi, following a request by Rastriya Swatantra Party President Ravi Lamichhane to pay the amount due and fight the case outside the jail.
Earlier, the Butwal High Court had ordered a complaint report in Lamichhane's case.
Lamichhane's case was presented to the bench of Butwal High Court Judges Milan Kumar Rai and Omprakash Aryal on Thursday. After the hearing, Joshi, in a similar case, had also requested to pay the amount as per the amount and sit outside the jail. After the district court rejected it, he had filed a petition in the Tulsipur Butwal High Court bench. Earlier, the district court had also rejected Lamichhane's demand and he had gone to the high court. The high court had earlier ordered a complaint report to be submitted.
During the Gen-G protest, the Tulsipur Butwal High Court bench was arson and vandalized. However, the case files of both Lamichhane and Joshi were saved from the arson and vandalism. Among the remaining files, Lamichhane's case was filed on Thursday. The bench of Justices Rai and Aryal ordered that both cases be filed together as they are of the same nature, said Ram Bahadur Kunwar, Information Officer of the High Court. 'Now the files of both cases will be filed together in the same bench,' he said, 'It is not yet decided when the next hearing will be scheduled.'
Lamichhane, who is in custody for trial in the Supreme Cooperative Fraud case, had filed a petition in the High Court on Bhadra 9 after the Rupandehi District Court did not release him even after he paid the amount of his share of the embezzlement in the cooperative. Earlier, he had filed a petition in the District Court demanding his release from the cooperative fraud case by paying the amount of his share. The bench of District Court Judge Narayan Sapkota had rejected his release while hearing his application on August 26.
A charge sheet has been filed against Ravi and the defendants in the Supreme Cooperative fraud case in Butwal, setting a collective amount of Rs 109.936 crore. However, Lamichhane had submitted a document stating that he had paid one part of the amount out of four parts. Lamichhane had submitted a bank guarantee of Rs 27.484 crore with the application.
Like Lamichhane, Joshi had also submitted a guarantee for the same amount. However, in the case of both the defendants, the same order was made that they should not be released as it was not certain how much amount would be fixed for their share.
Both Lamichhane and Joshi are in jail for trial. Lamichhane, who is in Bhairahawa Prison, has been transferred to Nakkhu Prison in Lalitpur. Joshi remains in Bhairahawa Prison.
