Writ filed for property rights of freedmen

A writ of writ of mandamus has been filed on the matter of public concern for the property rights of freed workers. Informal Sector Service Center INSEC, Advocacy Forum Nepal, Public Concern Legal Practitioners Group and Freelancers have jointly filed a writ of mandate.

After not being able to enjoy the full property rights of the land received from the government as a free worker, they have started a legal battle with rights activists and lawyers. For this, they have filed a writ petition for writ of mandate and extradition in the High Court Tulsipur Nepalganj Bench. 

Sitaram Tharu, Agnia Tharu, Seema Tharu of Muktinagar, Kohalpur Municipality-2, leaders of free workers, Agnia Tharu and other free workers, Lumbini State Coordinator of INSEC Bhola Mahat, Advocate Basant Gautam, Lumbini State Coordinator of Advocacy Forum, Bal Bahadur Chand of Public Concern Legal Practitioners Group, Jijaya Tiwari on behalf of Information and Human Rights Research Center jointly filed the writ on May 28. was done.  The single bench of Judge Poonam Singh Chand of the High Court Tulsipur Nepalgunj bench has issued a show cause order in the name of the opponents while conducting the preliminary hearing of the

writ. After receiving the answer from the opponent, the case will go to court and the court will give a decision after listening to both sides. Senior advocates Sunil Kumar Shrestha, Lok Bahadur Shah, Lumbini Province Coordinator of Advocacy Forum advocate Basant Gautam and advocate Vikash Acharya argued for the writ petition on behalf of the freed workers. 

Although the government has given the land on the condition that it cannot be transferred, sold, donated, or mortgaged for at least 10 years, it has been claimed in the writ petition that there should be a provision for the full enjoyment of the property rights of the land acquired in 2058.

More than 250 free workers requested for legal assistance with their documents. In this process, they submitted the file with the red portion of the land to the rights workers and advocates. 

In the case of land acquired by various commissions for 10 years as squatters, landless, free earners, and unorganized residents, they cannot be sold or transferred. 

Therefore, in the case of land whose 10-year period (condition) has been completed, it is claimed in the case that we issue an appropriate order including an injunction order in the name of these opponents, to make appropriate arrangements so that the land owner can sell the land registered in his name, transfer rights, share and even keep a mortgage, and not to do any act that would deprive him of that right. 

Similarly, in the writ filed in the High Court, in the case that the citizen has received temporary land owner registration evidence from various commissions as a squatter, landless, free earner, but the permanent land owner registration evidence of that land has not been provided for a long time, it has been requested that an appropriate order including an injunction order be issued on behalf of these opponents to collect the official details of that type of land owner, establish a registration list as soon as possible and issue a permanent land owner registration evidence. . 

Similarly, if there is any decision, correspondence, instruction, circular, etc. to prohibit the transfer of sale rights, share distribution of the land acquired as squatters, landless, free earners, even after the lapse of 10 years, and if there is any decision, correspondence, instruction, circular that does not give permanent land owner registration certificate to citizens who have obtained temporary land owner certificate, then it is unconstitutional and illegal decision, correspondence, instruction, A demand has been made in the case that the circular etc. should be declared inactive by a suitable order including transmission.
