Roshan Pokharel of Falgunanda Rural Municipality-6, Panchthar, who was arrested on charges of broadcasting insulting and abusive content on various social media platforms, including YouTube, targeting Prime Minister Balendra Shah and his family, has been released on a bail of Rs 25,000.
The Ilam bench of the Biratnagar High Court has ordered Pokharel to be released on a bail of Rs 25,000, overturning the order of the District Court of Panchthar to send him to prison for trial.
The order was made by a joint bench of High Court judges Kiran Pokharel and Kazi Bahadur Rai.
The bench of District Court of Panchthar, headed by Judge Kumar Maske, had earlier ordered Pokharel to be sent to prison for trial in a case under the Electronic Transactions Act. Pokharel had appealed to the High Court against the order.
The police had arrested Pokharel on 29 Chaitra 2082. Although he was suspected of treason during the investigation, he was later handed over to his family on the same day. After that, he also made public a video message apologizing.
But based on the police investigation report, the District Attorney's Office had registered a case under the Electronic Transactions Act on 18 Ashad 2083. Pokharel had approached the High Court after the District Court had ordered his imprisonment in the same case.
With the latest order of the High Court, Pokharel was released after posting a bail of 25 thousand rupees. The final decision on the case will be taken from the regular hearing of the court.
