Kabir Secondary School in Belbari, Morang has defied a court order. The school had dismissed primary school teacher Bishnukumari Khatiwada and third grade teacher Khem Bahadur Parajuli, citing the decision of the management committee meeting on Bhadra 10.
They were given a letter asking them to appear at the Belbari Municipality office. They filed a case against it in the Biratnagar High Court on October 24.
A single bench of Biratnagar High Court Judge Prakash Kharel issued a short-term internal order in the name of the school not to implement the decision and called both parties for discussion on October 30. A joint bench of High Court Judges Ganesh Thakur and Purna Prasad Rajbanshi ordered the reinstatement of both teachers on October 30.
The court order states that the decision made on August 10 asking the petitioner to appear at the Belbari Municipality did not mention any specific reason and that the decision and correspondence made without giving the petitioner any opportunity to defend himself should not be implemented immediately.
However, the school has not implemented the court order yet, said the victim teacher Khem Bahadur Parajuli. Parajuli said that the school principal and the chairman of the management committee were biased and defamed the court by not allowing him to appear even after a month of the order. School principal Abhay Limbu admitted that the court had ordered the teachers to appear but it could not be implemented for various reasons.
