The Act relating to the Provincial Assembly Secretariat was issued in 2075 BS. Section 8, Section 'D' of the Provincial Assembly Secretariat Act states that the qualification of a secretary should be 40 years of age and not more than 65 years, but Secretary Budhathoki has completed 65 years of age 15 days after completing the age limit of 65 years.

The complaint states that an investigation and action has been demanded, claiming that he received double benefits contrary to the legal provision that facilities should be received from only one source while holding a public position.

He has also been accused of receiving facilities illegally, thereby burdening the state treasury. The Commission for the Investigation of Abuse of Authority had written to the Provincial Assembly Secretariat on February 20, 2002, directing it to provide relevant documents along with a response to the allegations. Similarly, sources said that documents were also demanded to clarify the legal basis for the provision of travel allowance from government funds to a Bangladeshi citizen who visited Nepal during the annual celebration of the Provincial Assembly, which was illegal.
