The Patan High Court has upheld the judgment of the Kathmandu District Court in the case of copyright infringement against the couple Subas Regmi and Leela Sharma, owners of Vindhyavasini Music Pvt Ltd.

The joint bench of the High judges Lekhnath Paudel and Durga Prasad Dhungel heard the case on Tuesday and pronounced the decision to uphold the decision of the District Court Kathmandu. 

Singer Pramod Kharel filed a complaint in 2077 saying that Vindhyavasini Music Pvt. In that case, the Kathmandu District Court found him guilty of copyright infringement and ordered him to pay a fine of 10,000 rupees and return the album to the creator. But the public prosecutor filed a case again in Patan High Court saying that the sentence was less. 

Singer Kharel is the petitioner and the Government of Nepal is the plaintiff. Advocates Sajjan Varsingh Thapa, Shalikram Sapkota and Ishwar Adhikari argued on behalf of Kharel.

Regmi also filed a case in the Patan High Court to get the sentence quashed. The full text of the decision is yet to come. This is the first case against music for copyright infringement. With the victory of Pramod in this case, a new precedent has also been set in the music field.

What was the event?

singer Kharel released an album named 'Pranay' in 2066 . In all the four songs of the album, Pramod was the lyricist and composer. 

He signed an agreement with Vindhyavasini Music Pvt Ltd on 27th Chaitra, 2066 to distribute and market songs for five years. In the contract, it was mentioned that Pramod Kharelan would own the copyright. But even after five years, Vindhyavasini continued to distribute the song.

Pramod asked for his album back saying that the contract period was over. The dispute between Suwas and Pramod came to the surface . Subas started writing on social media abusing Pramod.

In 2077, 57 song creators signed a petition in favor of Pramod and filed a petition at the police complex. Regmi's wife was Leela Sharma, not Subwas Regmi, who was the legal owner at that time.

He was arrested by the police. Leela was released on a bond amount of 2 lakh 75 thousand. Lyricist Maheshchandra Acharya filed a complaint against Regmi in the bureau for killing his character in electronic form after Suwas did not stop using abusive language.

Regmi was arrested by Central Cyber ​​Bureau from Tribhuvan International Airport on 8 February 2079 while coming to Nepal from Thailand. He was released on 75 thousand bail .
