The Land and Property Search Commission has recommended to take back the 108 ropani land of Tribhuvan University in Kirtipur, which has been used for 24 years in the name of lab school, and collect rent. The commission has suggested to the government to collect the rent from the school since it has been using the land of the university.
A group of Congress treasurer and education worker Umesh Shrestha, former education minister and UML leader Krishna Gopal Shrestha have been operating a lab school under Guthi on the land of the university.
The lab school, which was opened for the students of the faculty of education of the university to practice teaching, has been running since July 13, 2057, under the guidance of Guthi, who is their patron. The Ministry of Education made an agreement to give land to Guthi for 15 years. After the 15-year contract ended, Trivi was urging the Lab School to vacate the land, but it was rejected.
The conclusion of the commission is that the Ministry of Education has allowed the land of the university to be used for the operation of private schools without the involvement of the University. It was found that the Ministry of Education allowed the use of the land of the University, without the permission of the landowner, it was found that they were doing business on public land by collecting fees from students and parents. We have recommended to remove the school," said a member of the inquiry commission.
According to him, the Abuse of Authority Investigation Commission and the Central Investigation Bureau (CIB) of the Nepal Police should carry out a detailed study-research on both those who allow and take private schools to operate on public property and bring them under the scope of legal action.
The investigation commission also gave the opportunity to the school owner to submit evidence that the land was allowed to be occupied by the university or that it was his. But another member of the commission said that since the principal Lakpa Sherpa, who came in contact, could not provide any proof, the commission came to the conclusion that the rent should be collected.
'Lab school was found occupying the land without the permission of the owner. Instead of removing it, it was seen that business was conducted by embezzling public property. "The university has repeatedly refused to admit students," he said to Kantipur, "Trivi should get the rent."
According to the procedures related to Trivi's lease or the prevailing law, the commission said that the government should take at least 24 years rent from the lab school. The commission has pointed out that there is a need for a detailed investigation as there is evidence of fraud committed by the school administrators to acquire the land of the University.
A member of the commission complained that a detailed investigation could not be done due to insufficient support from the Ministry of Education and the University administration. "The investigation could not be completed due to the non-cooperation of the government agencies including the Ministry of Education and Tertiary University in providing the documents," he said.
The Ministry of Education has been managing the school, which was opened for experimental practice for the students of the College of Education. In the year 2075, the then Ministry of Education and Sports handed over the management of this school to the Nepal Education Society, it is mentioned in the agreement.
It is mentioned that the agreement signed by the representative of the Ministry of Education and the member secretary of Nepal Education Society will be for 15 years. But in December 2016, the Ministry of Education allowed the school to be registered under the Public Educational Guthi.
Even though the university has been trying to vacate the land for 17 years, it has not been successful due to political influence, the professors and staff say. On December 19, 2064, a letter was sent by the Registrar's Office of the University to vacate the physical structure and land.
In 2066, 2070 and 2078, the university had asked to vacate the land. The contract period of Shiksha Samaj ended on July 12, 2072. After rejecting the correspondence made by the General Administration Division of the University Registrar's Office, a notice was also published in the Gorkhapatra on 26 October 2066 to vacate the land.
An employee of the Tertiary General Administration Division said that the lab school even rents the university's land voluntarily for the program. Lab School tried to establish a boundary by fencing the latter land and was stopped by Trivi.
In the year 2078, the school had written to the government agency along with the land office to transfer the land to its name saying that the university did not come to submit a claim regarding the said land and that it did not have any evidence. A member of the inquiry commission said that the school tried to make the land its own by writing a laboratory school in Kaifiyat Mahal of Fieldbook.
The Commission has suggested that 1000 ropani land of Trivi including Lab School has been encroached upon, 1000 ropani land has been lost since the compensation was distributed in 2013 and about 400 ropani land in Luvhu and Pulchok of Lalitpur should be searched. It is recommended by the commission to conduct a detailed investigation on the encroached land and take action according to the law.
On Tuesday, while understanding the Commission's report, the Chancellor of Tertiary University and Prime Minister KP Sharma Oli promised to take action against anyone who embezzles land. The Education and Health Committee of the Parliament instructed the government on Wednesday to publish the investigation report. Prime Minister Oli wrote on social media on Wednesday and said that the government will take action according to the recommendations of the commission.
'A coincidence - in the year 2076, we formed a commission under the leadership of Sharda Prasad Trital from the Council of Ministers to search for the land of Lalita Niwas. The case is going on in the process of bringing the land of Lalita Niwas under the name of the government," Prime Minister Oli said on Facebook, "After that, the Tribhuvan University Land and Property Search Commission was also formed under the leadership of Trital. The commission's study report has been received. The government will implement it by further studying the facts recommended in the report by the Land Search Commission of the University.' Prime Minister Oli has stated that the areas that were not and could not be studied by the
commission will be investigated further. Oli says, "After handing it, it will be finalized and left." The Commission submitted the report to Vice-Chancellor and Education Minister Vidya Bhattarai two weeks ago.
The Council of Ministers led by Pushpa Kamal Dahal formed a commission under the coordination of former secretary Sharda Prasad Trital on May 19 to search for the land of Angik Campus of Tertiary University and Usa Valley. Former joint secretary Mahendra Kumar Thapa and Janakiballabh were members of the commission as officers and experts from the University of India.
Sushila Adhikari, Deputy Secretary of the Ministry of Education, Science and Technology, was the Member Secretary in the committee. After Trital became unwell, the government gave Thapa the responsibility of coordinator last October.
