The study task force formed by the government has suggested to remove the 30-year service period in Nepal Police and Armed Police Force (APF) with conditions. The task force formed under the coordination of Jhak Prasad Acharya, joint secretary of the Ministry of Home Affairs, has suggested that the 30-year provision in both the security organizations is unscientific and incompatible with international practice and the provisions of internal bodies.

The task force has asked to maintain the tenure of both IGPs for 3 years, AIG for 4 years, DIG for 5 years, SSP for 8 years and SP for 10 years . It is said that the remaining posts will not have tenure and only the age limit for retirement will be maintained.

There are currently around 80,000 manpower in the police and 37,000 in the armed forces. Due to the 30-year service period, the higher-level officials have gone on compulsory retirement due to their age . Because of this, every year a large number of skilled manpower who are experienced in peace and security management and crime investigation and control go on compulsory retirement.

The then Deputy Prime Minister and Home Minister Ravi Lamichhane, under the coordination of Acharya, DIG Rajan Adhikari of Nepal Police, DIG of Armed Police Force Dipendra Shah, DIG of Nepal Police Force, under the coordination of Acharya, conducted a study on the retirement age, period and tenure of police personnel working in Nepal. A seven-member task force was formed including former DIG Purushottam Kandel, Deputy Secretary of the Ministry of Finance Jagadishwar Upadhyay, Deputy Secretary of the Decision Implementation Branch of the Ministry of Home Affairs Rishi Paudel and Deputy Secretary of the Police Personnel Branch of the Ministry of Home Affairs Krishna Gaihre.

After studying the previous working group and commission reports, international practice, national needs and legal provisions in other agencies within the country, the working group suggested that the 30-year service period in the police and armed forces should be removed and only the retirement age and term of office should be implemented .

'After studying and taking into account the international practice, the provisions of other agencies within the country and the current needs of the country, we have suggested to remove the current 30-year service period in the police and armed forces with conditions,' said Acharya, the task force coordinator, 'for this, the employees will develop their attitude and reach leadership. Possibilities and situations have also been studied, especially in the police and armed forces, we have also submitted bases with options on the form and when and how to implement this system.'  The government is strong enough to implement the report of the

task force. The federal laws made according to the federal structure should also be amended to suit this. Similarly, in the case of officers who are about to reach leadership, the issue of how to manage position matching and career development should also be implemented. According to the Ministry of Home Affairs, the draft law of both organizations will be prepared by covering the topics suggested by the report of the

working group. For this, the home has asked for suggestions from both the police. As the Supreme Court has mandated that the provisions of police service and conditions be included in the law instead of the regulation, the government is obliged to keep it in the law anyway.

The Supreme Court had already given a mandate to include the provisions of service and conditions in the law after the wrong trend prevailed to promote officers of their own accord by revising it due to the provision of service and conditions in the regulation.

Extreme politicization has been taking place in both the organizations on whether to keep the 30-year service period or not. The promotion of the police as a weapon to fulfill the interests of power has always been controversial. The task force has asked the police to phase out 30-year-olds. For that, it has been suggested that those who are going to retire should extend the period by 6 months and next year by one and a half years and take it into full implementation.

armed with V. no. It is suggested that this arrangement should be completely removed only after 2095 . If this is not possible, it has been asked to increase the number of ranks from SP to AIG and make promotion natural and remove 30 years.

When the Police Act 2012 came into effect, it was initially arranged that the police personnel would remain in their positions for as long as the Nepal government wanted. Until 2046, the subject of service period was not applicable in the police. It is said that a 30-year game has started in the police after the multi-party system to rip off their own arms and take the preferred officers to higher positions.

Due to political interference, the current Inspector General Ratnashamsher Rana was removed with a 30-year service period remaining. AIG Motilal Bohra was made Inspector General during the then Girija Prasad Koirala leadership in the year 2049 after Rana was removed and Bohra was made Inspector General .

The next year, the Koirala-led government, after the controversy over whether or not to retain the 30-year service period in 2050, the 'Police Reform Suggestion Commission Report 2050', formed under the coordination of the then Home Secretary Bir Bahadur Shahi, suggested that the 30-year period should be removed .

During the time of the then Prime Minister Pushpa Kamal Dahal, in 2065, under the coordination of professor Yuvraj Sangraula, the 'Report of the High Level Task Force on Modernization of Security Agencies - 2065 and the Report of the Study Task Force on Restructuring of Nepal Police Organization - 2073 suggested removing the 30-year service period as unscientific .

The report of the study committee for improving the performance and capacity development of the agencies under the home administration - 2081 also suggested that the 30-year provision should be removed . Although all the previous reports gave various suggestions, the government did not show much interest in implementing them.

When the period of retirement of the security officers comes, there has always been political bargaining on whether to keep the 30-year provision or remove the political maneuvers to bring the close ones to the leadership . The then IGP Bohra became IGP in 2049 by bringing a 30-year provision. This provision was removed during his tenure. In 2063, to prevent the then AIG Rajendra Bahadur Singh from becoming the IGP, the then Home Minister Krishna Sitaula sent him on retirement with a 30-year provision, the preferred Om Vikram Rana was made the IGP .

After Rana, AIG Hem Bahadur Gurung was again removed for 30 years and made IGP for a short term. After him, a 30-year provision was brought again. After Gurung, the IGPs from Rameshchand Thakuri to the current Basanta Bahadur Kunwar have reached the leadership through the 30-year provision . The 30-year provision is applicable after 2063 even in armed forces formed in 2068 .

Although the 30-year service period remains in the police and armed forces, this provision does not exist in the civil service, Nepali army, national research department, university professors/employees, health service, education service, federal parliament service.

Federal Police Service in India is only about age and tenure. The age of the Indian Police Chief under the Union is 60 and the term of office is 3 years . In Bhutan, the age of police chief is 60, senior officer is 58 and junior officer is 56 years and the term of office of chief is 5 years . The age of police chief in Bangladesh remains 59 years. In Pakistan, the age limit is 60, in China the age limit is 60 for men and 55 for women. Working group coordinator Acharya said that by studying the international practices, it has been suggested to maintain appropriate arrangements in both the security agencies. The

task force said that the 30-year system is unscientific and has suggested that the 30-year system should be completely removed by making a phased plan from 6 years to 10 years so that no one's career is affected.

According to Acharya, task force coordinator, it is suggested to keep the tenure of inspector general in police and armed forces for 3 years and the age limit to be 60 years. Age limit for AIG and DIG of both the organizations is 59 years and SSP and SP is 58 years, DSP and Inspector is 57 years, ASI to Senior SAI is 54 years, Constable to Senior Constable is 53 years and Office Assistant is 55 years.

Similarly, it has been suggested to reduce the existing 5-year tenure of AIG to 4 years, DIG's current 5 years, SSP's existing 6 years to 8 years and SP's current 10-year tenure . It has been suggested that staff college should be arranged in Nepal Police to reach the leadership or officers who are excellent in performance should be arranged to reach the leadership level .

It has also been suggested to make a special arrangement up to the SP in the case of the policemen going on compulsory retirement . Police jawan 10 years, police assistant constable, constable and senior constable up to 7 years, Asai and SAI up to 10 years, senior SAI up to 6 years, inspector 10 years, DSP up to 8 years in the same post, it is said to be promoted one level . At present there is a system of taking admissions from jawans and inspectors, it is suggested to remove the provision of taking admissions from Asais and make arrangements to take them from Sais .

"For the promotion of lower level employees, it is necessary to recruit from the post of Deputy Inspector of Police instead of recruiting through open competition for the post of Assistant Inspector of Police. By doing this, it is necessary to keep a provision for 80 percent promotion in the rank of police assistant inspector and 20 percent promotion through internal competition,'' the working group's recommendation states. Similarly, it has been suggested to amend the provision that the pension period is only available after 20 years of service, and arrange that the jawan/constable can retire after reaching the age of 16 and the Asai/sai after reaching the age of 18, but they will get the pension only after reaching the age of 20. By doing this, it is said that employment opportunities will be created for the citizens at the place of retirement.

'The existing service period of 20 years to take voluntary retirement by taking service benefits with pension will be changed from 20 years to 18 years for junior police officers and 16 years for police senior constables to police jawans. In the case of junior police officers, new police manpower will be appointed for 2 years and for senior police constables to police jawans for 4 years . It also promotes the condition of being more motivated and performing work while in the service, since they will have the opportunity to take voluntary retirement at an early age and work elsewhere, from regularizing the employment opportunities,' the report says, 'in addition to this, no additional grades should be given to the employees who are in the service, retirement payment after the service period limit is removed. Other employees who have reached their service period will serve for a long time, security personnel who have gained experience in the service and security sector will have the opportunity to take voluntary retirement and participate in foreign employment, and the remittances they bring from foreign employment will also have a positive effect on the country's economy. ;.'

Suggestion to maintain a special arrangement in the armed forces

working group in the armed police It has been suggested that the 30-year period should be removed only after 2095. The conclusion of the task force is that the force was born under special circumstances during the then armed conflict and the recruitment was also fast, so there is now a problem in its position management. To solve it, the working group suggests that the number of SP to AIG should be increased.

The provision of mandatory retirement due to 30 years of service in the armed police may not be scientific. "Many groups of employees were newly recruited in a short time to fill the human resources in the organization that was established in the special situation during the internal conflict, but because the organization has not been able to expand, there is a great problem in character development," the working group said about the armed police, "In the context of this background, the 30-year rule The decision to immediately remove the armed forces may not be prudent. It may not be rational for the officers who are currently at the lower level to reach the leadership level and have to stay for 26 years at the rank they entered the service. The

task force has stated that the number of employees who retire before reaching the service period of retirement has made it clear that they are not fully assured of their social security through the existing service in the armed forces, especially junior officers and other rank employees.

In view of the possible delay in the promotion of police personnel who have expected professional development in the near future due to policy changes, mandatory promotion after a certain period of service as mentioned in the Report 2081 of the Performance Improvement and Capacity Development Study Committee of the agencies under the Home Administration and also submitted in this report It is appropriate to apply the provisions of The working group has also suggested that legal provisions be made to ensure that the officers who have joined the service in the Inspectorate can reach at least the first grade (SSP/DIG).  The

of Armed Police Force (PGDSDMS) for SP (PGDMS), more than the provision of provision to promote a certain percentage (PRGDSDMS) more than the provision of the provision to lead. It is also suggested that the existing rules should be modified as worthy is seen at the leadership level and Nbsp ;. The

'Raidal layer of the narrow layer of the narrow level cannot be manufactured by the organization is required to build employees and microeches, physically, grow in the backup bridge, the backup office,' suggestions Is said & nbsp;.. The Surveyal Constitution of Border College in the District of Storm-BREAK will also create a monstrous posture and nbsp.. The task force states that the work of adding to the Armed Police Headfighter in the Armed Police Heath, the task force is mentioned and nbsp;. It is suggested to maintain the provisions of 16 years of age / maize for 18 years of age and pension facilities, such as 20 years, such as 20 years, such as 20 years, such as 20 years, such as 20 years.
