Twelve sick contracts for irrigation, which had been lying idle for years without work after making a contract agreement, have been terminated. Twelve sick contracts under the former People's Embankment Program Field Office No. 2, Jaleshwor, Mahottari have been terminated. A 15-day public notice has been published on 30 Ashoja to terminate six sick contracts of the Babai Irrigation Project.

Minister for Energy, Water Resources and Irrigation, Physical Infrastructure and Transport and Urban Development Kulman Ghising had instructed subordinate bodies to terminate sick contracts to end the trend of taking contracts but not working and leaving projects abandoned. Accordingly, the process of terminating contracts was taken forward.

The Irrigation and Water Resources Management Project, Janakpurdham, has stated that the contract was terminated because the construction contractor did not complete the work as per the agreement despite the public notice on 16 Jestha 2081 and 1 Shrawan 2081 on Sunday.

The office has stated that since no attention has been paid to the work despite repeated requests and public notices, action has been taken to confiscate the performance security as per the provisions mentioned in the agreement. In addition, it has been informed that the measurement of the work done so far and  evaluation of the remaining work should be completed within 15 days to take other necessary actions as per the provisions of the Public Procurement Act. The canceled contracts were made in the fiscal years 2068/69, 2069/70, 2073/74 and 2074/075.

Process to terminate 40 more road contracts begins

The process to terminate 40 more sick contracts that have been lying idle for years after no work was done on the construction of roads and bridges has begun. The Road Division Offices of Tumlingtar, Ilam, Hetauda and Nepalgunj under the Department of Roads on Sunday moved forward with the process to terminate 40 sick contracts under their jurisdiction. Tumlingtar has 17 contracts, Ilam 12, Hetauda 7 and Nepalgunj 4, asking why not terminate 40 contracts? They have issued a public notice on Sunday. Various road division offices have already moved forward with the process to terminate 68 sick contracts.

It has been stated that the construction work has been incomplete and neglected by repeatedly extending the contract and plan and not showing any interest in completing the construction work even within the specified period, and the construction entrepreneur has not been physically present at the work site for a long time, fundamentally violating the contract.

It has been stated that the construction entrepreneur has violated the contract agreement by not showing any interest in completing the construction work even after requesting and informing in writing and verbally on various dates. A public call has been made to the authorized person to appear at the office with a revised work schedule that can complete the work within 15 days of the publication of the notice, a reliable plan for resource mobilization, a commitment to complete the work, and an explanation with factual evidence if there is any reasonable reason not to break the contract. If the contractor does not show readiness to start the work within the stipulated time, action will be taken to terminate the contract and blacklist the contractor as per the provisions of the Public Procurement Act, and to recover the performance security, deposit amount, advance security and 10 percent interest on the advance amount, as well as to recover the remaining expenses incurred for the work as government dues.
