The Labor Court has ordered the employment of Nepal Airlines Corporation (Nepal Airlines) flight attendants (cabin crew). The order was given by the bench of Labor Court Judges Janakraj Pandey, Nisha Bania and Shailendra Kumar Chaurasia.
After the hearing of the case filed in the Labor Court after the Supreme Court said that she should not retire from the service through an interim order, the Labor Court has given the order to employ the senior flight attendant Prajita Karki today.
The case of 135 attendants and nurses regarding age discrimination and service facilities is pending in the constitutional bench of the Supreme Court. The order of the Labor Court has asked Karki to provide service facilities for a fragmented period from October 18.
Advocates Anantaraj Luintel, Vikas Bhattarai and Vishal Thapa argued on behalf of Karki and insisted that he cannot be removed from service against the order of the Supreme Court. Karki lawyer Luintel informed that the labor court ordered the corporation to attend the discussion regarding the continuation of the interim order on June 18.
Nepal Airlines Corporation had filed a lawsuit against the provision of 50 years in rule 63 (1) (b) of the Staff Administration Regulations 2058. Sandher Karki was retired when he reached the age of 45. A case of contempt has been filed against the corporation's board of directors in the Supreme Court due to the forced removal.
Supreme Court Justices Hariprasad Phuyal and Nripadhwaj Niraula's joint judgment stating that there is a question of interpretation of a serious constitutional issue, the case has been sent to the constitutional bench for hearing on May 13. The bench has continued the interim order issued a year ago in favor of the petitioners. In the
writ petition, it is mentioned that according to the provisions of the law regarding the service and conditions of the employees of Nepal Airlines Corporation, flight attendants and flight attendants are treated differently from other employees and are treated as second class employees. In the case of flight attendants and flight attendants, the retirement age has been set at 58 years, they have been asked to retire at 40 years, they can remove any grievance by giving them a month's salary, they can retire with a contractual agreement throughout the service period, and no gratuity has been requested. writ, they claim that no facilities were ever removed without having worked in the same position for a lifetime and no treatment was given to social security. They complain that the government-owned Nepal Airlines Corporation has discriminated against their cabin crews because the general company should ensure social service security. It is mentioned in the writ petition that they had to file a writ petition in the Supreme Court as they did not proceed with the improvement process when they repeatedly raised the issue with the management.
After the order of the labor court, the nurse Karki responded that she got justice. She expressed her belief that she will get justice from the court for not having a hearing when she repeatedly requested the administration to remove the discriminatory provisions in the regulations.
