Amendment of SEZ regulations to speed up industry registration

After the delay in the industry registration and operation process, the government has amended the Special Economic Zone Regulation 2074 to speed up the work. Mainly 5 points have been amended in the regulations which have been published in the gazette and have been implemented. The conclusion of the Special Economic Zone Authority is that after the amendment, the work will increase rapidly.

 

Industry is willing to come to SEZ. But it took a long time to complete the process including registration and operation, there was a delay in the establishment and operation of the industry," Tulsiram Marasini, Information Officer of the Authority said, "The amendment has been made according to the authority given by Section 59 of the Special Economic Zone Act 2073. The regulation has been published in the gazette and has come into effect. Now we are hopeful that the work will be done quickly. In the sub-rule (1) of rule 11 of the

regulation 2074, the place of purchase of documents and its fee, the method of sending the proposal, the place, date and time of submitting the proposal should be given a deadline of 45 days to select a suitable proposer on the basis of competition. It was mentioned that there should be a deadline of 45 days for topics such as the last date for submitting the proposal, the place of opening the proposal, the last date and time, the estimated date for deciding on the proposal, the basis for evaluating and selecting the proposal, the evaluation of the technical and financial aspects of the proposal, and the opening of the financial proposal only after evaluating the technical proposal. Now 30 days notice will be enough.

Rule 14 of the original rules has been amended. In sub-rule (9) of rule 14, instead of 'within 30 days', 'within 15 days' has been substituted. Now, the expert committee does not have to submit a report with recommendations within 30 days of starting the work for selecting the proposal that gets more marks along with the marks obtained in the technical and financial proposals. Submitting a report with recommendations within 15 days is sufficient.  According to

gazette, rule 31 of the original regulation has also been amended. In place of the word 'one-door unit' in Rule 31 of the regulation, 'one-door unit or industry registration body according to prevailing law' has been placed. It has been arranged that any company registered in the relevant body can participate.  Rule 32 of the

original rules has also been amended. In sub-rule (1) of rule 32 of the original regulation, the word "within 15 days after the completion of industry registration" has been deleted. The obligation of the licensee to enter into an agreement with the authority regarding the establishment and operation of the industry within 15 days of the completion of the industry registration has been removed. Clause (k) of sub-rule (2) is also omitted. 

In sub-rule (2), in addition to the matters mentioned in section 11 of the Act, the name and address of the industry, investment plan, concessional facilities etc. should be mentioned in the contract. Clause (k) mentioned that other essential subjects should also be covered. With the implementation of the new regulations, there is no need to mention any other important issues. According to the authority, this will create a more conducive environment for industry operations. Earlier, the government also included SEZ in the ordinance to amend some laws related to economic and business environment improvement and investment enhancement. 

Marasini said that the minimum 60 percent of the established industries under the SEZ has been removed and reduced to a minimum of 30 percent. It was a practice not to take a plot and operate the industry. It has been arranged that a mandatory agreement must be made within 120 days after amending it.
