under Road Division Bhaktapur Contract No. DROBK T/33701138/078/79/15, Improvement Of Araniko Highway Dhulikhel Dolalghat Road Section NH34 Dhulikhel Khawa Section (30+000-34+155.47Km) for the construction work of the contractor Shri Gauri Parvati Nirman Seva Pvt Ltd Kathmandu and Road Division Although there was an agreement between Bhaktapur in 2079-2-20 and an agreement to complete the entire work by 2080-12-19, the contract has been canceled as the physical progress according to the schedule of the purchase agreement has been very low so far, according to the division office Bhaktapur. According to Suman Yogesh, head of the

office, it has been found that despite repeated written and verbal requests to the builder, he has not fulfilled his contractual obligations according to the terms of the contract, despite the fact that he did not show interest in completing the construction work in a timely manner, even when he had repeatedly written to him, even when he published a notice saying why he would not take action to terminate the contract, the written explanation given by the Pvt.

In the current situation, there is no construction work on the road, and the local people/consumers are suffering because of the fundamental breach of contract according to Section 59(2) of the Public Procurement Act, 2063 and GCC Clause 72.3(g) of the contract agreement, and the provision of GCC Clause 72.1 (c) of the contract agreement and essentially, the construction business has not created a reliable situation to complete the contract.
