Fines and imprisonment arrears are increasing every year in District Court Makwanpur. The speed with which the verdicts have been passed, the fines and imprisonment have not been recovered.
Due to non-collection of penalties as per the order of the district court, the outstanding amount of Makwanpur district court has reached 4 billion 81 crore 43 lakh rupees. In the same way, the cost of imprisonment of the court is increasing every year due to the fact that the criminals who should be imprisoned due to punishment by the court do not stay in prison. Arrears have also increased by 250 years compared to last year.
"Criminals sentenced to imprisonment and sentenced to pay fines are going on the run," said Advocate Ishwar Dhakal. Legal practitioners claim that the justification of the judgment lies in the implementation of the court order.
Court information officer Keshavraj Kaushik said that the court is not only sending the door to collect the remaining arrears and fees, but the court is cooperating with the police administration to collect the extortion.
There are 4,872 natives and foreigners who have been found guilty in various cases by the district court but are absconding. According to the district court, 97 of them are foreign nationals and 4,779 are Nepalis.
Makwanpur District Court has records since 1983 and the arrears are also from the same period.
Convicted but absconding persons are required to be brought to court to enforce court judgments and reduce outstanding court arrears and imprisonment charges. Lawyers say that if the decision of the court cannot be implemented, the faith towards the court will gradually decrease.
The increase in the remaining arrears and imprisonment costs and the fact that the person who should be incarcerated or pay a fine according to the court's decision remains absconding, raises questions not only about the implementation of the court's decision, but also about the justification of the decision,' said Advocate Madan Dahal.
An officer of the court said, "The court does not have its own police, it has to rely on other security agencies."
