Navina Bishta (name changed) living in Birendranagar Municipality-9 got married to Vinod Simkhada of Kalikot in November 2079. His marriage did not last even two years. After a short love affair, Navina and Vinod got married with the permission of both parents.
After 2 years of marriage, Vinod started pressuring her for divorce and Navina could not bear the torture and finally she was forced to divorce . Married at the age of 19, she got divorced at the age of 21. "As soon as I got married, I had a child in my stomach. I stayed as much as I could because of the respect of my family and my family, but I could not bear his pressure," she said. Her mother Lalsari Bista says, 'My daughter's life has become a mess, at the age of holding Kapikalam, she has added responsibility for herself and her son, even if I send monthly expenses to my son and wife, they are out of touch.' She married a young man from the village and raised two children. She got married at the age of 18 and got divorced in January 2080. "I got married at a young age and left everything and chose my husband, but now I have to live alone," Pratima laments, "I became a mother at a young age, on the one hand my physical condition became weak, on the other hand the mental stress caused by my husband." The young man who said that he will provide money for his son's education after divorce is not in contact with Pratima now . She has reached the support of Maiti with her children . According to the data of Surkhet District Court, 2,376 cases out of 3,081 cases have been divorced in the last 5 years. In most of the cases that came to the court, child marriage and domestic violence were found to be the way to end the relationship.
In Surkhet, Rukumpaschim, Salyan, Jajarkot and Dailekh in Karnali province, it has been found that divorce between husband and wife is high, while it is lowest in Humla . Surkhet District Court Srestedar Nirmalakumari Khadka says that the number of complaints has increased after the implementation of the new Civil Code.
A new civil (civil and criminal) code was implemented from August 1, 2075. The said law has also opened the way for men to divorce. Srestedar Khadka says, "Early men could not divorce easily, even if they had to do it, it would take years." Now a husband and wife get divorced within 2 days.'
According to District Court Surkhet, 85 percent of the 2,376 divorced women filed a complaint in 5 years. According to Srestedar Khadka, it is found that women reach the decision of divorce to be financially independent and free from domestic violence. She said that the number of complaints has also increased due to polygamy, mismatch, love marriage and the trend of not accepting same existence. Complaints made by women are mainly due to the husband not taking responsibility for the family, living with other women, while in the complaints made by men, it is found that the wife stays in the same house, childlessness and abuse with other men.
Advocate Durga Sapkota says that instead of domestic violence, complaints of partial divorce have started coming in the last year. "Earlier there used to be cases of beatings and partial land ownership, but now there are a lot of people who come for divorce because they are not satisfied within a year of marriage," he says. "The new Civil Code has made it very easy to get a divorce." Anil Dhakal, who is working in the field of street children, says that the children are on the wrong path due to the discord between their parents. "The mental balance of many children has been affected due to the lack of good relationship between parents," he said.
Meena Singh (name changed) of Dailekh's Bhagwatimai rural municipality-6, who got married at the age of 17, got divorced at the age of 24. He has a 4-year-old son . Husband was an army employee . Explaining the reason for the divorce, she says, "When I got married, I had no job. I struggled a lot, but now that I have a job, I don't want to stay with you. They say that I am in love with the girl inside me." She says that her husband tortured her a lot for the divorce. After the divorce, she only got the barren land of the village. She has been living in Maiti after the divorce, despite the assurance that she will support her son and herself.
In the 5-year data of Dailekh District Court, 536 couples have divorced. Kalpana Thapa, deputy head of Athabis Municipality, says that the number of complaints has increased as women are becoming self-reliant and also understanding violence. According to her, many divorce cases have reached the court because of the change in the consciousness of women who consider abuse and neglect by their husbands as a daily routine and want to live independently. Srestedar Mandira Shahi of Rukum West District Court says foreign employment and child marriage are the main reasons for the increase in divorce. From here, most of the men and women go to America and different countries for employment. Many divorce when they return, she said. Some mothers who are married at a young age do not even have citizenship. She said that 80 percent of the women who come to the district court do not have citizenship. "They get married at a young age and they don't even get citizenship after their husbands stop caring," she said. Surendra Kumal, the 26-year-old husband of 23-year-old Vina Kumal of Dullu Municipality-13 Malika, got married for the second time. After 8 years of marriage with Vina, Surendra took 19-year-old Sapna Vick from Dulluk as his second wife . "I have a small daughter in my arms, when my daughters need a father, they brought in another wife," she said, "even if the second wife gets married, she will look after us, so I was forced to file a complaint of polygamy after not being in contact with my wife." If we look at the latest statistics of the court, it can be seen that the number of polygamy and divorce has increased due to the fact that those who drop out of education and get married as children are not able to become financially independent.
Advocate Surendra Adhikari says that men are also active in filing divorce complaints. "In the cases I have looked at, I have seen that most divorces are due to child marriage," he said, "After the divorce, the number of those who run to the court because the husband does not look after the children has also increased." Since 5 years in 10 district courts of Karnali, 5 thousand 958 divorce cases have been filed in 7 thousand 307 divorce cases. Among them, 5 thousand 43 complaints were filed by women and 1 thousand 630 complaints were filed by men. Most of the complaints are due to modern lifestyle and independence seeking, lack of trust, culture and social change, awareness of self-esteem and increased divorce.
Shreshdar Shahi of Rukum West District Court said that the number of complaints was high after legal awareness. She said, 'Physical, mental or emotional abuse makes it difficult to maintain a relationship, so people prefer to be alone.'
