In the far west, local level services are in disarray

Currently, all the 88 local level employees of Sudurpaschim Province are protesting demanding the release of the Act on Service Conditions. They have been staging a phased protest centered on Dhangadhi for 4 days, stopping all services except essential ones.

In accordance with Article 227 of the Constitution, there is provision for the provincial government to make an Act on the formation and operation of local services. Out of the seven provinces, the law has been issued and implemented in all the provinces except Far West. But the Far West government failed to pass the law and the employees were in trouble. Due to the non-promulgation of the Act, problems have arisen in terms of character development, service stability, post-filling, and post-retirement facilities for the employees employed at the local level. The employees say that they were forced to take to the streets due to the indifference of the provincial government, repeated assurances and political laxity. 

In January 2080, the state government passed a bill on service conditions passed by the council of ministers and submitted to the state assembly. Then on 29th of July 081, the State Assembly sent the bill to the State Affairs and Legislation Committee for quarterly discussion. The committee reached all the nine districts for seven months and prepared a report and registered it in the Assembly on 15th January 2018. However, the winter session ended without putting the bill on the agenda until 081 Chait 25. 

081 On Chait 28, various trade unions submitted a letter of attention to the Chief Minister with joint signatures. In that letter, it was mentioned that if the law is not promulgated as soon as possible, the program of struggle will be announced. After his visit to India, Chief Minister Kamal Bahadur Shah promised to pass the Act in the Assembly on 28-29 Baisakh. But they could not issue the law as promised. After the Act was not promulgated, on May 26, a gathering of employees working in all 88 municipalities of Sudurpaschim Province formed the Provincial Struggle Committee and announced the struggle.

The National Federation of Municipalities Nepal Far West Province Working Committee, Heads, Deputy Heads, Ward Chairmen of various municipalities have also expressed their solidarity in this. Some people's representatives came to the streets and participated in the protest.

Jhalak Bahadur Daulayal, Coordinator of the Local Level Employees State Sangharsh Samiti, says that despite the continuous verbal and written requests of the employees, no decisive initiative has been taken. He says, "We hoped for many dates like tomorrow/Persi, Kartik 15, Mansir Masanta, Pus Masanta, Magh 15, but all the promises turned out to be false."

Hira Sarki, Minister of Internal Affairs and Law of the state, has said that a meeting of the state assembly will be held on May 10, and a decision will be taken to pass the law. The Act has been stopped due to the obstruction of the opposition party. Now, we will pass the law immediately after meeting in the Provincial Assembly, he said. He has asked the agitating employees to remain steadfast in the passage of the Act. 

What are the demands of the movement?

- Act on the service conditions of local level employees should be issued immediately

- State Assembly meeting should be convened as soon as possible, otherwise the law should be issued through an ordinance before the meeting

- Employees have demanded that the state public service commission should conduct the process of filling vacant positions in 88 municipalities by issuing laws and regulations.  

Sangharsh Committee has taken a stand to continue the struggle program until the Act is promulgated. The committee said that the number of employees participating in the movement is increasing day by day and the remaining employees will also come to Dhangadhi to participate. The committee has taken a strategy to involve local officials in the struggle as well.
