The death of 22-year-old Anju Tharu of Bardiya Badhaiyatal-4, who was denied citizenship and a share from her husband due to discrimination, has been registered. Similarly, her seven-year-old daughter Anita Tharu also received a birth certificate on Wednesday. Now, Anita will get citizenship and one-third share from her father's property when she comes of age.
Neglected by her husband, Anju filed a case in the court for a share of the inheritance. The court had ruled that she should get the inheritance, but she could not get the inheritance due to lack of citizenship.
The ward and district administration refused to grant her citizenship. They even refused to register her daughter Anita's birth. On 22 Kartik, Anju committed suicide at home after not being able to get citizenship, while her father, 61-year-old Kanchha Tharu, who had been struggling for justice with her, also followed his daughter's path four days later.
After the news of Anju and her father Kanchha choosing the path of death was published in the Kantipur Daily, the Ministry of Home Affairs formed an investigation committee after Prime Minister Sushila Karki took an interest and gave instructions. On the same day the committee began its work, Anju's death certificate and Anita's birth certificate were obtained on Wednesday.
After Anju's death, an abetment case was filed against her husband Anil Tharu and an arrest warrant was issued. Anil is currently absconding. Anil's father Prasad Tharu was the witness and Anita's birth certificate and Anju's death certificate were obtained. The court had decided that Anil would receive three parts of the property, with Anil, Anju and Anita getting one part each. However, since Anju has now passed away, only Anita's share will remain and Anita will get the share decided by the court when she reaches the age of majority, said Chief District Officer Gogan Bahadur Hamal.
The birth certificate of 7-year-old Anita was obtained in the presence of Joint Secretary of the Home Department and Coordinator of the Investigation Committee Suresh Panthi. When the committee coordinator Panthi, members of the Home Department Deputy Secretary Kulshekhar Aryal and Assistant Chief District Officer of Bardiya Ashok Kumar Bhandari, Chief District Officer Hamal, Administrative Officer Bimal Gurung and Superintendent of Police Saroj Poudel, and other members reached the spot, the victim's family members expressed their hope that justice would be served.
The committee met and questioned the victim's family and Ward Chairman of Badhaiyatal-4, Naray Thapa, separately on Wednesday. After the inquiry, the ward prepared and handed over Anita's birth certificate and Anju's death certificate.
After the birth certificate of niece Anita and the death certificate of Nanda Anju were issued, Suman Kumari Tharu said, "I have to lose my life to get justice, where is the justice? Anju, who was not granted citizenship while she was alive, has now easily obtained her death certificate. Anju, frustrated by not being granted citizenship, was forced to commit suicide. Whoever put her in that situation should be investigated and punished."
Anju had a love affair with Anil when she was 14 years old. Anju became pregnant as a result of their relationship. After that, Anil took Anju to a temple, married her and brought her into his house when Anju was 15 years old. On 24 Mangsir 2075, Anju gave birth to a daughter. Unable to bear her husband's abuse, Anju returned to her parents on 24 Poush 2076 with her daughter. When Anil did not want to continue the relationship, Anju filed a case in the Bardiya District Court on 8 Magh 2076 demanding a share.
Even though Anju claimed that the child born to her was not her daughter, Anil hesitated when the court ordered a DNA test, saying he was not ready. The court did not annul the marriage, saying that there was no complaint even though the marriage was underage. The District Court of Bardiya ruled that Anju would get a share.
The National Human Rights Commission is also studying the issue of a father and daughter committing suicide due to negligence in government structures for obtaining citizenship.
