Based on the Supreme Court's order dated Magh 4, the Metropolitan City is going to continue the previous system.
Kathmandu Metropolitan City has lifted the ban on building construction on both sides of the river.
Issuing a public notice on Wednesday, the Metropolitan City said, 'Based on the order of the Joint Bench of the Honorable Supreme Court dated 2082 Magh 4, the permission to construct a building on the private land of any person will not be stopped and the structure under construction will not be stopped.'
The construction permit was stopped by the chief-level decision of 2081 Shrawan 24, 2081, based on the decision of 2080 Mangsir 1, 2080 in the case filed by Advocate Prakash Mani Sharma on behalf of the Public Interest Protection Forum (Pro.Public). The notice mentioned the issue of 'not granting permission to construct a building on an additional 20 (twenty) meters of land in addition to the criteria specified in the measurement map of the rivers within the metropolitan area, and stopping the construction work.'
On Magh 4, a joint bench of Supreme Court Justices Sunil Kumar Pokharel, Bal Krishna Dhakal, and Nripadhwaj Niraula has ordered that some aspects of the previous order be reversed. The brief order states, "In the case of the Bagmati River and its tributaries, the map will be approved only by leaving an additional 20 meters on the right and left, in addition to the criteria set by the Council of Ministers on 2065/08/01, in the case of a river or stream, a minimum limit of 20 meters on the right and left from the bank will be determined, in the case of no structure has been built within the added distance, the land within that distance will be declared a construction prohibited zone and construction permission will not be granted, and in the case of a land within the said additional 20 meters, the map will be approved as per the law and buildings etc. will be constructed on the land within the said additional 20 meters, permanent structures will be constructed in the riverbank area and the land required for the smooth flow of rivers and streams will be acquired by providing compensation as per the law, to that extent, the decision of the joint bench dated 2080/09/03 is considered to be somewhat reversed."
The Metropolitan City is going to implement the previous arrangement based on the court order regarding these cases and demands filed in the Supreme Court.
