A joint bench of Acting Chief Justice Tek Narayan Kunwar and Justice Murari Babu Shrestha of the High Court in Janakpur has sentenced former member of the House of Representatives Mahato, suspended Provincial Assembly member Sharma, along with Dharmendra Rai, Ram Shankar Mishra, Suresh Pandey and Pawan Kapar to five years in prison each in the death case of ASI BK.
Similarly, in the same case, the High Court of Janakpur has decided to sentence the defendants Pradeep Sah Majhi, Sanjay Kumar Sah and Mohan Thakur to life imprisonment for the offence of murder under Section 1 of the then National Code of Nepal, as per Section 13 (3) of the same section, informed the court's Information Officer Ganesh Pandel.
The Mahottari District Court had sentenced all three to life imprisonment on 28 Mangsir 2080 and acquitted former MPs Mahato and Pawan Kapar. The Mahottari District Court has upheld the decision on life imprisonment in the case of all three, according to Information Officer Pandey.
The High Court verdict states that the death of the deceased Thaman BK occurred in the line of duty, a complaint has been filed against all three defendants Pradeep Sah Majhi, Sanjay Kumar Sah and Mohan Thakur, all three admitted the charges during the investigation, and while being taken for treatment, ambulance driver Sushil Mishra and Pappu Kumar Sah, Siyaram Paswan and Rajkumar Jha, who were with him, confirmed their involvement to the investigating officer.
The court order also states that the defendant Sanjay Kumar Sah attacked Thaman BK from the photos of the incident.
Similarly, in the case of former MP Mahato, suspended provincial assembly member Sharma, Dharmendra Rai, Ramshankar Mishra, Suresh Pandey and Pawan Kapar, it is mentioned that objective evidence of direct attack on the statement of the accused, who have been sentenced to life imprisonment, has not been found, but based on the circumstantial statements of the defendants, who have been sentenced to life imprisonment, it has been stated that they have committed the offence of murder under Section 17(2) of the Civil Code. It is stated that an ASI who came to Mahottari for work on Bhadra 25, 2072, during the Madhesh movement, was beaten to death by a BK protestor.
