Due to the lack of a mutual legal assistance treaty between Nepal and India, 137 cases related to dual citizenship that have been pending in the District Administration Office have been pending for three decades.
Based on the complaint filed by the Indian citizens regarding the citizenship of Nepal, the district administration office handed over the case file to the district police office Parsa for the necessary investigation of the case, but the police has not been able to conduct the necessary investigation in the case and come to a conclusion.
As there is no mutual legal assistance treaty between the two countries, the Nepal Police has not been able to formally receive any information or information from the Indian police regarding whether the accused persons are Indian or not and whether they have dual citizenship or not, says Parsa Police spokesperson DSP Kishore Lamsal. "We have written to the Indian Embassy through the Ministry of Home Affairs, the Ministry of Law and the Ministry of Foreign Affairs through the police headquarters in some of these cases," he said, "but there is no information from the Indian side about the formally accused Indian citizens." "We can't go directly to India and understand it," he said, "We cannot consider Indian government websites as official." He said that since this case has an unlimited scope, the accused person can always come under the scope of action. DSP Lamsal says that only 60 cases were registered in 2077/078 out of 137 cases.
The chief district officer of Parsa, Ganesh Aryal, says that when he asks the Indian embassy about such cases, he does not get an answer. "There is no information about sensitive documents on the Internet," he said. He said that in such cases, the district administration office conducts preliminary investigation and sends the case to the district police office. "Since the investigation is done by the police, the case is entrusted to the police," he said.
During the distribution of citizenship after the Madhesh movement in Birgunj, there have been complaints from the public that many Indians have taken citizenship. Some of these people have been filed complaints by people who have a dispute in the neighborhood or personally. But there are complaints that many people with dual citizenship have not yet come under the scope of action.
