A bulldozer has been used on the houses built on the land of Durbar Marg in Butwal Sub-metropolitan City-4. The municipality, with the help of the municipal police and Nepal Police, used the bulldozer while the businessmen were removing their goods themselves. At the request of the Tulsipur Butwal Bench of the High Court, the sub-metropolitan city used the bulldozer to clear the encroached land of the High Court.
The bulldozer was used on the 9 unauthorized houses in the area of 2 bighas 5 kattas 14 dhurs of former plot no. 396, which were encroached on the west side of the road on Durbar Marg, north of J.C. Chowk in Butwal Sub-metropolitan City-4.
The land extending from J.C. Chowk to the north, from the drinking water office to the south and from the road in front of the bench to the west has been encroached on. The government document stated that the land, which was in the name of the then Zonal Officer, was made available to the then Appellate Court (currently Tulsipur High Court, Butwal Bench) after the Zonal Office was abolished in 2046 BS.
After that, the court searched the land registered in its name, but was unable to remove those who had built houses and huts encroaching on it.
According to Thirendra Kumar Subedi, the information officer of the High Court, the court had first issued a notice on the removal of unauthorized houses and huts on Asoj 10, 2070 BS. For the second time, on Baisakh 23, 2071 BS, a study committee was formed to search for the land and search for the encroached land. However, due to the lack of interest from the subsequent court chiefs and local levels, the land could not be protected.
Currently, Chief Justice Basudev Acharya of the High Court has shown interest in searching and protecting the land. The former plot no. Information Officer Subedi said that the construction of the court building itself has progressed on an area of 1 bigha 9 katta 3 dhur of 607.
Currently, more than 15 people are building houses and doing business on the 396 plots of encroached land. Some have rented it out. The Nepal Bar Association unit building has also been built there. Businessmen, employees and political party leaders have also built houses on the encroached land. They claim that the houses were built on the decision of political parties in the absence of public representatives.
The Land Squatters Problem Resolution Commission had provided land ownership certificates to 8 people from the court land in 2052 BS. UML leaders were on the then commission. After the Congress filed a complaint against it, saying that government land was distributed on the basis of party support, the District Land Revenue Office had canceled the land title in 2069 BS based on the secretary-level decision of the Ministry of Land Reforms.
