The bill to open the way for the establishment and registration of domestic alcohol production industry in Gandaki province has been passed by the Parliament.
With the passing of a bill to amend the Gandaki Province Industrial Business Act, 2075 by the Provincial Assembly on Monday, the legal basis for registering domestic alcohol production industry has been prepared.
The amendment bill has added a restrictive phrase after sub-section 3 of section 4 of the original Act, which has facilitated the registration of industries producing domestic, local or raithane liquor . "But this sub-section shall not be deemed to prevent the registration of domestic or local or Raithane liquor production industry based on local raw materials," said the phrase.
The government had registered the amendment bill in the provincial assembly on 14 Jan 081 . The bill registered by the government did not include this restrictive phrase . After a general discussion in the assembly, the bill was sent to the Finance and Development Committee on February 22 last year. During the monthly discussion in the committee, the government brought a bill to legalize domestic alcohol and there was no provision for industry registration for it. After this, the committee prepared the legal basis for domestic alcohol industry registration by adding a sentence that does not hinder the registration in the final report.
The government had registered a bill in the provincial assembly to regulate and manage the production of domestic alcohol in 081 Chait . The bill is currently under discussion in the Finance and Development Committee. Sub-section 1 of Section 3 of the Liquor Bill stipulates that no person, firm or company can produce, collect, process, package and distribute sales without registering the industry. Due to this arrangement, the Finance Committee has added a restrictive phrase that can register the domestic alcohol industry in the revision of the Industrial Act.
Article 27 of the original Act has been added to the work, duties and rights of the single point service center through amendment . It has been arranged that the work related to industry administration including establishment, permission, registration, cancellation can be done from one place . Coordination and facilitation needed to obtain land for industry, lease and provide land in excess of the limit will also be from this center.
Sub-section 1 of Section 33 prohibits any type of building construction and residential development within the provincial industrial corridor, industrial area, industrial village and industrial cluster or within the area and distance specified by the provincial government. However, this provision stipulates that if a building or a settlement cannot be developed on private land, the government must compensate for it in sub-section 2 . Subsection 2 prohibits building construction and settlement development in industrial corridors, industrial zones, industrial villages and industrial clusters declared by the Union Government. The
bill, section 35 (b) of the original Act provides that the registration of small scale industries or domestic industries with a fixed capital of up to 10 lakh rupees can be done at the local level according to the relevant local laws. Until there is a law at the local level, the provisions of the regulations prepared on the basis of the Act will be attracted.
The provisions for the formation of provincial business platform for the promotion of necessary cooperation, identification of obstacles, regular and transparent dialogue between the private sector in the section 34 of the original act have been made in the amended bill.
