Earlier, the hearing of the case on December 13, December 6 and December 2 was also on the list of postponements and inadmissible. Locals including Bindabasini Kansakar had filed a writ petition in the Supreme Court demanding protection of their houses and property during the road expansion.
In the case registered against the Division Road Office, Hetauda, Hetauda Sub-metropolitan City and the Ministry of Physical Infrastructure and Transport, a single bench of Justice Meghraj Pokharel had issued a 'show cause order' in the name of the defendants on December 19.
The Supreme Court had also issued a 'short-term interim order' not to proceed with the road expansion work immediately. Despite repeated requests to discuss the continuation of the same order and the interim order, it has been included in the list of 'not allowed to be seen' and 'not allowed to be seen'.
According to the plan to widen the road of Hetauda Bazaar by 25/25 meters, houses and huts in the market area were demolished on November 20. Locals including Kansakar had approached the Supreme Court against the project. The writ petitioners in the case have been arguing that personal property should not be damaged without proper compensation and legal process.
The Division Road Office demolished more than 500 houses and huts within the 9.5-kilometer road boundary from Ratomate to Buddha Chowk to Rapti Bridge (Mahendra Highway) and from Buddha Chowk to Chowkitol (Tribhuvan Highway) on November 20 for the road expansion of the main market area of Hetauda.
The main market is currently in disarray due to the fact that there is no electricity and the road is dusty. After the Road Department demolished the front part of the house with a dozer, those who own the land behind it are demolishing the remaining structures themselves.
Since the victims filed a case in the Supreme Court, both sides have been summoned. But the case has been delayed due to the inability to see the judge's bench or the inability to see the case. The Supreme Court has fixed the hearing for December 29. The Road Division Office in Hetauda is currently sitting quietly as the case has not been resolved.
The Road Division has stated that it is unable to move forward with the road expansion and management work due to legal complications. Road Division Chief Guru Prasad Adhikari said that the office is forced to 'stay with its hands tied' until the Supreme Court orders it. The Road Department, local administration and victims of the houses that were demolished are demanding that the court put this case on the preliminary list and dispose of it.
There is a list of 234 houses, huts and structures on the right side of the road and 297 on the left side within 25/25 meters from the center of the road that need to be demolished. Of those, about 500 structures have now been demolished.
