Writ against CJ-led govt: Hearing deferred
KATHMANDU, MAR 02 - The scheduled Supreme Court hearing on a writ filed against the parties' decision to form an election government under sitting Chief Justice Khil Raj Regmi was deferred on Friday.
According to the list prepared by CJ Regmi himself, the hearing on the writ was to be conducted before a special bench of Justice Girish Chandra Lal. However, as the hearing was placed 58th on a list of 59 case hearing s, it was deferred citing a lack of time.
On February 27, advocate Om Prakash Aryal had filed a writ against the parties' proposal to form a CJ-led election government. In the writ, Aryal had argued that the constitution does not envision a former Justice, let alone a sitting chief justice, taking up the post of the executive head. Article 106 (1) of the Interim Constitution provisions that the CJ or a Justice can be deputed for judicial enquiry into matters of national importance.
